Alabama Act 2011-535;The "Immigration Act"
As
you may have heard,portions
of
Alabama Act 2011-535, commonly known as the"Immigration Act," are now in effect. I believe this law affects your department's issuance
of
house numbers to new applicants. I
do
not believe this law affects house numbers that have
al
ready been issued by your department.Before issuing a house number to an individual, certain measures must be taken
to
ensure thattheindividual is either aUnited States citizen or
is
otherwise lawfullypresent in theUnited Sta
tes.
Before issuing a house number to a general partnership,the same measures must
be
takento ensure each partner is either a Untied States citizen or is otherwise lawfully present in
th
eUnited States.
If
an individual claims to be a United States citizen, require them to
do
two things:I. He/she must provide one
of
the documents listed on Exhibit A to this memo; and
2.
He/she must initial the applicable line and sign the declaration attached as Exhibit B to this memo.
If
an individual claims he/she is not a United States citizen but is,instead,an alien prese
nt
in theUnited States lawfully, require them to
do
two things:
1.

Exhibit C to this memo;and 2. He/she must initial the applicable line and sign the declaration attached to this memo as Exhibit

If
the individual or general partnership will not comply with these requirements,
do
notissuethehouse number. These requirements do not apply
to
corporations, limited liability companies,orlimited liability partnerships.Madison County, Alabama
is
in the process
of
registering for the Systematic Alien VerificationforEntitlementsProgram ("SAVE") which isoperatedby the United States Department
of
Homeland Security. Once Madison County
is
fully registered, each individual who claimshe/she isanalien lawfully present in the United States must be verified through SAVE. More information regarding SAVE will followonceregistration is completed.A non-marked copy
of
Exhibit B
is
alsoattachedhereto for use byyourdepartment.
