Re: Demand that Barack Obama not be allowed on Texas presidential ballot Per Subsection (f) of Section 145.003 of Texas Election Law as he is not a Natural Born Citizen by self-admission To Whom This May Concern: The Texas Democratic Party according to Texas 192.031 is allowed the following by law: PARTY CANDIDATE'S ENTITLEMENT TO PLACE ON BALLOT. A political party is entitled to have the names of its nominees for president and vice-president of the United States placed on the ballot in a presidential general election if: (1) the nominees possess the qualifications for those offices prescribed by federal law; As a Texas registered voter, I am writing to advise you that I am protesting the placement of Barack H. Obama on our State Ballot due to the following. Article 2 Section 1 Clause 5 of the United States Constitution states No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States. The Men who drafted our Constitution left the definition of the term Natural Born Citizen out of the document, so you might think that it can mean whatever you wanted it to; but, in 1875 the Supreme Court in Minor v Happersett defined the term Natural Born Citizen to be someone born in the United States to citizen parents. As you notice it does not say citizen parent, and that is important to their decision, as they go on to say that a candidate for the Presidency of the United States could not have conflicting loyalties. Unless a Constitutional amendment is passed to eliminate the Natural Born Citizen clause of Article II, Section 1, then Barack Obama needs to be removed from the Texas

Presidential ballot under Subsection (f) of Section 145.003 of Texas election statutes. A memorandum of law is forthcoming to further support the Constitutional ineligibility of Barack Obama because he was born a British citizen to a Kenyan national father by his own admission during the 2008 Presidential campaign and continues to assert this to this very day.
