QUESTION PRESENTED
The minimum coverage provision of the Patient Pro-tection and Affordable Care Act, Pub. L. No. 111-148,124 Stat. 119, as amended by the Health Care and Edu-cation Reconciliation Act of 2010, Pub. L. No. 111-152,124 Stat. 1029, provides that, beginning in 2014, non-exempted federal income taxpayers who fail to maintaina minimum level of health insurance for themselves ortheir dependents will owe a penalty, calculated in parton the basis of the taxpayer’s household income and re-ported on the taxpayer’s federal income tax return, foreach month in which coverage is not maintained in thetaxable year. 26 U.S.C.A. 5000A.The question presented is whether the minimum cov-erage provision is a valid exercise of Congress’s powersunder Article I of the Constitution.
