According to the Lost Boy edministrative control panel, an individual using the sereen name “MR BEAN" joined the message board on September 5, 2007.! Since then, MR BEAN has made approximately 160 public posts to other message board users. Many of these posts include child pornography or are responses to message threads containing child pornography posted by other board members. For example: a. Onor about March 30, 2008, MR BEAN posted a message titled “cj/ryan'" to the pictures section of the Lost Boy message board. This post contains 29 thumbnail images which, when clicked, expand to full size. Seven of the images depict a minor boy, approximately 12 - 13 years old, with a baseball bat inserted in the boy's anus. Two of the images depict what appears to be the same boy, with a Crayola marker inserted in his anus. In the message, mr bean wrote "almost baseball season..." b. On or about May 30, 2008, MR BEAN posted a message titled “P101” in the “Pictures” section of the message board, He subsequently posted two responsive ‘messages to his own “P101” post. Each of the three messages contained thumbnail images which, when clicked, expand to full-size images. These thumbnail images depict, among other things, prepubescent boys being anally penetrated by adult men, an adult man touching the erect, penis of @ prepubescent child, and prepubescent boys orally copulating each other and adult men. Ina follow up message to this message thread, MR BEAN posted a message stating "approx 5,000 pics in 1gig* (including a lot of dupes) is what i have so far”. ©. On or about November 28, 2008, defendant MR BEAN posted a message titled "from a variety of sets" to the “Pictures” section of Lost Boy. This message contained 62 thumbnail images which, when clicked, enlarge to full-size images, These images depict young boys in various states of undress, some exposing their genitals and some of them "The MR BEAN screen name on the Lost Boy message boerd is in all lower case, “mr bean.” For purposes of clarity in this affidavit it will be capitalized Page 15Case: 2:10-mj-00617-TPK Doc #: 1 Filed: 09/30/10 Page: 21 of 50 PAGEID #: 21 masturbating. For example, one image depicts a nude, prepubescent bay kneeling on a bed with his buttocks in the air exposing his anus, scrotum, end penis. There is semen on his buttocks. In the text of the message, defendant MR BEAN asks, "these are all related series but i only have these pics in a mixed file. does anyone have the full sets of these boys?" ss. Each of the images described in sub paragraphs a, b, and c, above, depict a different child, SAGER es reviewed these images, and they appear to depict real children; nothing in the images suggests to her that they are digital creations, Further, the images were posted in the Pictures section, not the “art” section, where members were told to post digital images. These images were posted through a server in Texas, and members all over the world (such as Tracy and Sarafian, in California) could access them; thus, they necessarily traveled in interstate and foreign commerce tt. Asset forth above, section 2252(g) requires that defendant receive, distribute, or transport child pomography, (or one of the other enumerated child exploitation felonies) as part of a series of felony violations constituting three or more separate incidents and involving more than one victim, While the plain meaning of the statute requires only that a defendant commit one felony, while the enterprise commits three or more, MR BEAN personally received, solicited, and transported child pornography on more than three separate incidences, involving more than one victim, By receiving, distributing and soliciting the images through Lost Boy, he did so in concert with three or more other persons. D. Lost Boy Member MR BEAN is Registered Sex Offender CHRIST i KLEIN at the SUBJECT PREMISES wu, Futoshi Tachino and Joshua Boras are members of Lost Boy. On September 22, 2009, both were indicted by a federal Grand Jury in the Central District of California for his participation in Lost Boy. (United States v, Sarafian, et. al., 09-68A-VBF). Both Tachino and ; on multiple occasions between March and August 2010, SA) interviewed Tachino and Boras in the presence of their attorney. According to Tachino, @ number of Lost Boy members originally met in a chatroom called "Lair,” which catered to individuals with a sexual interest in boys. While one of the main purposes of Lair was to trade pictures of young boys, the members generally did not post “hardcore” child pornography. Other members of Lost Boy were referred through a board known as “PI.” The P| board is known to be for individuals who prefer hard core images of child pornography.? According to Tachino, MR BEAN belonged to both Lair and to the Pl boards prior to joining Lost Boy.* xx. According to Boras, MR BEAN is the administrator of the PI board, and Boras confirms that MR BEAN used the screen name “L.ookit” on the P] Board. This is consistent ‘with a message sent via Lost Boy from MR BEAN to Lost Boy member “bb687," on or about January 19, 2009, in which MR BEAN signs the message “cheers lookit.” yy. WASTE is an anonymous, secure, and encrypted tool which allows users to ‘communicate and share files, The program was developed to allow small companies or teams of people to easily communicate securely and efficiently. However, according to Tachino, Lost Boy In this context, “hardcore” generally refers to images depicting vaginal or anal penetration of a child. *According to Tachino, MR BEAN used the screen name “Andy” when participating in Lair. Tachino thought “Andy” could be MR BEAN’s true first name. Although Tachino referred to “MR BEAN” and “Andy” interchangeably, for the sake of this affidavit I will simply refer to MR BEAN, Page 17
