The Promoter commits to promoting the Performer in a manner that emphasizes the exclusivity and privileged natureof the performance. The Promoter will supply promotional copy and media for The Performers use in promotions.The Performer or authorized representative of the Performer may submit reasonable change requests to promotionalmaterial within 24 hours after presentation. After 24 hours, in absence of any change requests, the promotionalmaterial will be assumed acceptable and cleared for use.
Additional Terms and Conditions
The Promoter grants the Performer a limited license to use any of the artwork on the Event Sites for thepurpose of promoting the Event and linking to the Event sites. The Performer grants the Promoter a limited license to use thePerformer¶s logo and likeness in Event promotional material and on the Event site. The Performer may provide a press-kit to thepromoter with materials that have clearance for promotional use.
Recording, Reproduction, Transmission, Photography:
The Performer may provide their own photographer andcinematographer to create photographic and video recordings of the performance. The Performer or their respectivephotographer or cinematographer shall be the sole owner of these photographic and video recording. Performer will grant a gratislicense to Promoter to use the material contained within these photographic and video recordings for reasonable promotionalpurposes only. The Promoter may create photographic recordings of the performance. The Promoter¶s photographer shall be thesole owner of these photographic recordings. The Promoter¶s photographer will grant a gratis license to the Performer and thePromoter to use the material contained within these photographic recordings for reasonable promotional purposes only.
Right to Sell Merchandise on Premises:
The Performer is granted the right by the Promoter to sell any legal merchandise atthe Event. A request for table or booth space in order to exercise this right must be received in writing no later than 11:59 P.M. onMarch 4
, 2011. The Performer must provide their own staff to administer merchandise sales. The Performer retains all proceedsfrom merchandise sales.
Meals, Transportation, Lodging, and Hospitality:
The Performer is responsible for all meals and transportation as is required inthe fulfillment of this contract.
The Promoter agrees to provide airfare for one individual, hotel accommodations for onenight, water, sodas, and 4 drink tickets at the Event
. The Promoter agrees to provide i) a backstage area limited to thePerformer, Club staff and other performers, ii) a 6 person guestlist, and 2 parking spaces.
Sound and Production:
The Promoter will provide sound and lighting through the Venue's existing systems as well as theexpertise to run them properly. The Performer will provide their own instruments, cables, stands, microphones and anyspecialized monitoring equipment (in-ear or otherwise). The Performer will provide to the Promoter a technical rider within 14days of signing this agreement. The Promoter commits to any additional costs that this technical rider may incur to the limit of $100. The Promoter also reserves the right to negotiate technical rider terms and seek cost-effective solutions.
The Performer will not be held liable for any loss or damage to any equipment owned by the Venue or Promoter unlesssuch damage is due to negligence or willful destruction by the Performer (i.e. drink spilling or dropping gear). The Promoter willnot be held liable for any loss or damage to any equipment owned by The Performer unless such damage is due to negligence or willful destruction by the Promoter or their staff (i.e. drink spilling or dropping gear). The Performer will be held liable for arrivingand faithfully performing all covenants in this contract before and during the Event.
The Performer may cancel their performance at the Event for reasons that would not be qualified as µArts of God¶or beyond their control. Cancellation will remove the obligation of the Promoter to compensate the Performer for any servicesrendered. The Performer will be liable for any and all expenses incurred by the Promoter in the course of promoting thePerformer¶s engagement at the Event, and any and all expenses made to announce the cancellation of The Performer¶sperformance and create new promotional material. The Promoter may additionally claim loss of anticipated profits.
Termination by Breach of Contract:
The Performer will be found in breach of contract for failure to uphold their ExclusivityCommitment or Promotional Commitment. The Promoter may, in their sole discretion, choose to terminate the performance for The Performer¶s breach of contract. In the event of performance termination, The Performer will be liable for any and all expensesincurred by the Promoter in the course of promoting the Performer¶s engagement at the Event, and any and all expenses made toannounce the termination of The Performer¶s performance. The Promoter may additionally claim loss of anticipated profits.
