ARTICLE I. GENERAL.
SEC.49-1. In this chapter: (1) ACT meansthe FederalWater Pollution Control Act, alsoknown as the CleanWater Act. as amended, U.S.C.1251,et seq. 33 (2) AMENABLE TO TREATMENT meansthat a substance: (A) (B) and (C) does not pose a health or safety threat to city employeesor contractorsperforming work in the wastewatersystem. (3) APPLICANT meansa person who makes application to receive a service from the department. (4) APPROVAL AUTHORITY meansthe Director of the TexasCommissionon Environmental Quality (TCEQ). (5) AUTHORIZED REPRESENTAIIVE OF THE INDUSTRIAL USER means: (A) if the industrial user is a corporation, doesnot dischargeor interfere with the operationsof the wastewatersystem; is acceptablefor streamdischargeand normal sludgedisposalmethodsusedby the city; DEFINITIONS.

(i) the president,secretary treasurer,or a vice-presidentof the corporation in chargeof a principal businessfunction, or any other person who performs similar policy or decision-making functions for the corporation; or (ii) the managerof one or more manufacturing,production, or operating facilities, provided the manageris authorizedto make managementdecisionsgoverningthe operation of the regulatedfacility (Examplesof managementdecisionsor activities include, but are not limited to, having the explicit or implicit duty to make major capital investmentrecommendations, and initiate and direct these comprehensive measures assurelong-term compliancewith environmentallaws and regulations; to having the authority to establisha systemto gather complete and accurateinformation for individual wastewaterdischargepermit requirements;and having the authority to sign documentsand bind the corporation in accordancewith corporateprocedures.); (B) if the industrial user is a partnershipor sole proprietorship,a generalpartner or proprietor, respectively;

SECURITY DEPOSIT REFUNDS.

(a) Refund requirements. The director may refund a security deposit to the customerwhen the customermeets the requirementsof Section49-4(D or meets all of the following conditions: (1) (2) The customerhas been receiving service for 12 continuousmonths. The customerhas acquired a satisfactory credit history with the department.

(3) The customerhas not made payment during the past 12 months with a payment device returned due to insuffrcient funds. (4) The customerhas no delinquentbills outstanding.

(b) Refusal to refund. Notwithstanding Subsection(a), the director may refuse to refund a security depositwhere the director determinesfrom the circumstancesof a customer'saccount that there is a substantialrisk of financial loss to the department. (c) Review for eligibilitv. Upon the requestof a customer,the director shall review the customer's credit history to determineeligibility for a refund. The director will make refunds in the following manner: (1) A refund will normallybe creditedto a customer's bill.

(2) If a refund is greaterthan the outstandingbill, the remaining portion of the refund will be applied to subsequent bills. (3) If a customerno longer has an account for service or in specialcircumstances approvedby the director, the director may authorize a refund by check payable to the customer. (Ord. Nos. 19201; 2696t\ SEC. 49.7. PAYMENTS OF FEES FOR SERVICES; DELINQUENCY OF CHARGES; DISCONTINUAI\CE OR REFUSAL OF SERVICE; NOTICE OF DISCONTINUANCE. (a) When chargesare delinquent:bill items. Except where otherwiseprovided by written contract between the customerand the city, chargesfor servicesfurnished become delinquent if payment is not received by the departmenton or before the due date, which is 15 days after bill rendering. After the due date, the customermust pay all chargesfor service,plus a late payment fee equal to five percent of the outstandingchargesfor service (unlessthe late payment fee is prohibited, or otherwiseprovided for, in another city ordinance or stateor federal law). The director shall sendthe customera monthlv bill

indicating: (1) the servicedate and the due date;

(2) the amount due for servicesrendered(including all previous delinquent charges,plus interest,if any, still due and owing) if the bill is paid by the due date; and (3) the amount due for servicesrendered(including all previous delinquent charges,plus interest,if any, still due and owing), plus a late payment fee, if the customer fails to pay the bill by the due date. (b) Bill not received. Failure to receive a bill from the director does not relieve a customeror other person liable for chargesunder this chapter from liability for service. (c) Authoritv to discontinueservice. The director may refuse application for service,discontinue service,or refuseto restoreserviceto: (1) a customerwho fails to pay any chargesdue under this chapter within sevendays after the sending notice of discontinuance; of (2) a person who violates any provision of: (A) (B) (C) (D) (E) (F) Section49-9; Section49-16; Article III or Article IV of this chapter; Article V or Article VI of Chapter 32 of this code; Chapter5l or 51A of this code,upon requestof the building official; or the DallasPlumbingCode;

(3) a person making application for service to property at an address,if the personhas delinquent chargesoutstandingat another address;or (4) a customer at any premisesif the director determinesthat a substantialwaste of water, or a health hazard,is occurring as a result of leaking damaged,open or disconnectedprivate laterals,pipes, or drains on the premises. (d) Cuttinq and plusging connections. The director's authority to discontinueservice includes the right to cut and plug water or wastewaterconnectionsto private property. The costsof cutting and plugging connectionswill be chargedto the customerin addition to the delinquent chargesdue. (e) Restorationof service. Discontinuedservice will not be restoreduntil the customeror other person who has or acceptslegal responsibilityfor violations committed or chargesunpaid either pays all chargesdue (including the chargesto restore connections),makes arrangements payment satisfactory for to the director, or, where applicable,ceases violation of the particular code provision in question. The decisionto restore service while delinquent chargesor code violations still exist rests solely with the director.

(f) Notice of discontinuance. The director must notifu a customer in the following manner before discontinuingserviceunder Subsection(c): (1) The director must sendthe customerat least sevendays advancewritten notice of pending discontinuance. (2) The notice must provide a statementof reasonsfor cutoffand a statementof delinquent chargesdue, where applicable. The notice must also provide a time, place and meansby whichthe customermay cure the delinquency or violation, or dispute the validity of the reasonsfor discontinuance. (3) The notice may be servedeitherin personor by mail.

(4) Additionally, in casesof master-metered apartmentsor condominiums,the director must causea notice of pending discontinuanceto be posted on the door of each dwelling unit known to be occupied and in a conspicuousplace within the property manager'soffice or the common areasof the premises. (g) Exceptions to notice requirement. Subsection(f) doesnot apply to discontinuanceof service resulting from a violation of this chapter if the director determinesthat immediate discontinuanceis necessaryto prevent an imminent threat or occurrenceof: (1) (2) (3) harm to the health or safetyof persons; damageto city or private property; or contaminationof the water system.

(h) Customer'srequestto discontinue. Upon a customer'swritten request,the director may discontinuetreated or untreatedwater serviceto the customer. Upon receipt of the request,the director may remove the water meter and service connections. However, the customeris liable for all charges incurred prior to removal of the meter. Where serviceis furnished through more than one meter, the customermay requestdiscontinuanceof one or more meters and thereafter be billed on the basisof the remainingmeter or meters. (D Cumulative remedies. Enforcement of this section does not waive any additional remedies,civil or criminal,availableto the city under law. (ord. Nos. 19201 ;20215;20653:26961\ SEC. 49-8. NEW APPLICATION FOR PREMISES WITH DELINQUENT CHARGES. (a) When new application not accepted. Where service has been discontinued,refused or posted for discontinuanceat a premisesdue to nonpaymentof delinquent chargesor a violation of this code, a new application will not be acceptedfrom another personto resumeservice in the sameplace under another name so long as the previous customercontinuesto occupy or own the premisesas his residence or place of businessuntil: (1) (2) (3) all delinquent chargesare paid; alrangementsfor payment satisfactoryto the director are made; or the violation is abated.

welfare of the personrequesting it. (4) The health, safety, and welfare of other personsmust not be adverselyaffected by granting the variance. (e) Revocation of variances. The director may revoke a variance grantedwhen the director determinesthat: (1) (2) (3) the conditions of Subsection(d) are not being met or are no longer applicable; the terms of the complianceagreementare being violated; or the health,safety,or welfare of other persons requiresrevocation. (Ord. Nos. 24745;26518) Sf.C. 49-22. TEMPORARY DISCONTINUANCE FOR CONSTRUCTION, MAINTENANCE OR EMERGENCY REASONS. (a) Reasonsfor temporary discontinuance. The director is authorizedto temporarily discontinue service to premisesfor the following reasons: (1) when a main break or other failure in the water or wastewatersystemscould injure persons, private or city property, or other parts of the systems; (2) (3) to perform routine maintenanceor repair to any part of the water or wastewater systems; to perform emergencymaintenanceor repair to any part of the water or wastewatersystems;

(4) in other casesof emergency, when necessary protect the generalhealth, safety or welfare to ofpersons;or (5) to make a connection to a newly constructedor relocated water or wastewatermain.

(b) Responsibilities upon temporarv discontinuance. In all casesof temporary discontinuance,the director must restore service as soon as is practical and must take all reasonablestepsnecessaryto protect the public health and safetyunder the circumstances. (ord. 19201) SEC.49-23. AUTIIORIZED EMPLOYEES; RIGHT OF ACCESS OF EMPLOYEES FOR INSPECTION AND MAINTENANCE: ACCESS OF CONTRACTORS. (a) Authorized emplovees. The director shall designatethose individuals who are employedby the departmentand authorizedto carry a credential of the department. No person other than an authorized employeeshall have or use any credential of the department. An employeemust surrendercredentialsto the director upon termination of employment or at the requestof the director. (b) Right to access. An authorizedemployeeshall carry a credential when dealing with the general public. Upon presentationof the credential, an authorizedemployeeshall have free access,at reasonablehours, to private premisesreceiving service,for the purpose of reading or inspectinga water meter, a backflow prevention device or for other service-relatedactivities. Only an authorizedemployee may have free accessto parts of the water and wastewatersystemsfor purposesof operation,

(c) Administrative searchwarrants. The municipal court shall have the power to issueto the director or city environmentalhealth officer administrativesearchwarrants, or other processallowed by law, where necessaryto aid in enforcing this article. (d) Penalties.A personwho violatesany provisionof this article or any term or conditionof an industrial waste dischargepermit granted pursuantto this article is guilty of a separateoffense for each day or portion of a day during which the violation is continued. Each offense is punishablebv a fine of not lessthan $1,000or more than $2,000. (e) Criminal responsibilitv. A person is criminally responsiblefor a violation of this article if the person knowingly, recklessly,intentionally, or with criminal negligence: (1) commitsor assists the commission a violation, or causes permitsanotherpersonto in of or commit a violation; or (2) owns or managesthe property or facilities determinedto be the causeof the illegal discharge under Section49-43,49-44,49-46, 49-55.6,or 49 -55.7 . (f) Civil actions. This article or the terms and conditions of a dischargepermit grantedpursuant to this article may be enforcedby civil court action as providedby stateor federallaw. (Ord. Nos. 19201; 19682;21409; 26925;28084) SEC. 49-43. SYSTEM. CERTAIN WASTES PROIIIBITED IN THE WASTEWATER

(a) Generalprohibitions. A person shall not dischargeinto the wastewatersystem,or causeor permit to be dischargedinto the wastewatersystem,any pollutant that causesa passthrough or interference. (b) Specific prohibitions. A person shall not discharge,or causeor permit to be discharged,any of the following pollutants into the wastewatersystem: (l) Inflows or infiltration, as illustrated by, but not limited to, storm water, ground water, roof run-off, subsurfacedrainage,a downspout, a yard drain, ayard fountain or pond, or lawn spray. (2) Wastewateror industrial waste generatedor produced outside the city, unlessapproval in writing from the director has been given to the person dischargingthe waste. (3) A liquid or vapor having a temperature higherthan 150 degrees Fahrenheit(65 degrees Centigrade). (4) Gasoline,kerosene,naphtha, fuel oil, vapors, or any other pollutant that createsa fire or explosionhazard in the wastewatersystem,including but not limited to industrial waste with a closed cup flashpointof lessthan 140 degrees Fahrenheit(60 degrees Centigrade). (5) A pollutant that will causecorrosive structural damageto the wastewatersystem,unlessthe portion of the wastewatersystemdirectly or indirectly receiving the dischargeis specifically designedto accommodatethe corrosive discharge. (6) Usedmotor oil.

(7) A solid or viscouspollutant in amountsthat will causeobstruction to the flow in the wastewatersystem,resulting in interference. (8) Heat in quantitiesthat will causethe temperatureto exceed 104 degreesFahrenheit(40 degreesCelsius)at any point in the wastewatersystemor will otherwise inhibit biological activity in the wastewatersystem,unlessthe director expresslyapprovesalternatetemperaturelimits in the discharger's industrial waste dischargepermit. (9) Solid or liquid substances quantities capableof causingobstruction to the flow in in wastewatermains or other interferencewith the proper operation of the wastewatersystemas illustrated by, but not limited to, ashes,cinders, sand,mud, straw, shavings,metal, glass,rags, feathers,tar, plastics, wood, whole blood, paunch manure,hair and fleshings,entrails, lime slurry, lime residues,slops, chemical residues,and paint residuesor bulk solids, except when such items as lime slurry or lime residuesare used in the treatment of combined storm and wastewaterduring storm runoff. (10) A pollutant capableof forming a toxic gas,vapor, or fume in a quantity that may cause, either by itself or by interaction with other waste,hazard to life or acute employeehealth or safety problems. (11) Garbage that is not properly shredded definedin Section49-l(81). as

(I2) Except where the director has determinedthat different limits under an industrial waste dischargepermit are appropriate,wastewaterexceeding 200 m/L of oils, fats, and grease(measuredas total oil and grease). (13) A substance having a pH value lower than 5.5 or higlrerthan 10.5.

(14) Radioactive materialsin a manner that will permit a transient concentrationhigher than 100 microcuries per liter. (15) Unusualtasteor odor producingsubstances, unlesspretreated a concentration to acceptableto the director so that the material does not: (A) (B) (C) (D) (E) causedamageto collection facilities; impair the city's treatment processes; incur treatment costs exceedingthose of normal wastewater; render the water unfit for streamdisposalor industrial use; or create a public nuisance.

(16) A dischargeof water, normal domestic wastewater,or industrial waste that in quantity of flow exceeds,for a duration of longer than 15 minutes, more than four times the average24-hour flow during normal operation. (17) Without the approval of the director, a substance pollutant other than industrial waste, or normal domesticwastewater,septic tank waste, or chemical toilet waste that is of a toxic or hazardous nature, regardless whether or not it is amenableto treatment, includingbut not limited to bulk or of packagedchemicalproducts.

(18) Except at dischargepoints authorizedby this chapter,or by regulationspromulgatedby the director that are not in conflict with this chapter or other laws, wastewateror a pollutant that is trucked or hauled. (19) Any other pollutant,substance, materialnot amenable treatment,or of a or to concentrationor quantity sufficient to harm the wastewatersystem,as determinedby the director. (c) Local limits. It is a defenseto prosecutionunder Subsection(a) of this section and to a civil court action enforcing Subsection(a) of this section if a person can demonstratethat: (1) a specific numeric local dischargelimit to prevent passthrouglr or interferenceexists under this section for each pollutant in the person'swastewaterdischargethat causedpassthrough or interference and the person'swastewaterdischargewas in compliancewith the applicablespecific local dischargelimit for each pollutant directly prior to and during the passthrough or interference; or (2) if a specific numeric local dischargelimit doesnot exist under this section for the pollutant in question,the person'swastewaterdischargedid not changesubstantiallyin nature or in constituentparts from the person'sprior wastewaterdischarges when the city was regularly in compliancewith its Texas Pollutant DischargeElimination Systempermit and, in the caseof interference,with applicable federal requirementsfor wastewatersludgeuse or disposal. (e) Enforcement actions. If a person discharges substanceinto the wastewatersystemin a violation of this section, fails to comply with the reportingrequirementsof this article, or falsifies or improperly alters pretreatmentrecordsrequired under Section 49-51,the director may take any of the following actions: (l) Suspenddischarge. After informal notice, immediately suspendor halt an industrial user's discharge. (2) Terminateservice. Terminatewater and wastewaterservice to the premisesfrom which the substance was discharged. (3) Suspendor revoke permit. If the personwas dischargingwastewaterpursuantto an industrial waste dischargepermit issuedunder Section 49-46,revoke or suspendthe permit. (4) Require pretreatment. By administrativeorder, where applicable,or by other authorized means,require pretreatmentor control of the quantities and rates of dischargeof wastewaterto bring the dischargewithin the limits established this section. by (5) Criminal or civil enforcement.

(A) Requesta court of competentjurisdiction to assess civil fine againstthe industrial user a in an amountof not lessthan $1,000.The fine will be assessed a per-violation,per-daybasis.In the on caseof monthly or other long-term averagedischargelimit violations, the fine will be assessed each for day during the period of violation. The director may serve a written notice of violation. This doesnot prevent the director from taking any action, including an emergencyaction or any other enforcement action, without first issuinga notice of violation. (2) Consentor administrativeorders. The director may enter into consentorders,assurances of compliance,or other similar documentsestablishingan agreementwith an industrial user responsiblefor noncompliance.The agreementmust include specific action to be taken by the industrial user to correct the noncompliancewithin a time period specifiedin the agreement.The agreementhas the sameforce and effect as the administrativeorders issuedpursuantto Sectiona9-a3@)@)and is judicially enforceable. (3) Show causehearinq. The director may order an industrial user that has violated, or continuesto violate, any provision of this chapter,an individual wastewaterdischargepermit, or any other pretreatmentstandardor requirement,to appearbefore the director and show causewhy the proposedenforcementaction shouldnot be taken. Notice must be served on the industrial user specifzingthe time and place for the meeting,the proposedenforcementaction, the reasonsfor such action, and a requestthat the industrial user show causewhy the proposedenforcementaction should not be taken. A show causehearing is not a bar against,or prerequisitefor, taking any other action againstthe industrial user. (4) Complianceorders. When the director finds that an industrial user has violated, or continues to violate, any provision of this chapter or any other pretreatmentstandardor requirement,the director may issuean order to the industrial user responsiblefor the dischargedirecting that the industrial user come into compliancewithin a specifiedtime. If the industrial user does not come into compliancewithin the time provided, wastewaterservice may be discontinuedunlessadequatetreatment facilities, devices, or other related appurtenances installed and properly operated.Issuanceof a complianceorder is not are a bar against,or a prerequisitefor, takingany other action againstthe industrial user. (5) Ceaseand desistorders. When the director finds that an industrial user has violated, or continuesto violate, any provision of this chapter or any other pretreatment standardor requirement,or that the industrial user's past violations are likely to recur, the director may issuean order to the industrial user directing it to ceaseand desistall such violations and directing the industrial user to: (A) immediately comply with all requirements;and

(B) take such appropriateremedial or preventive action as may be neededto properly addressa continuing or threatenedviolation, including halting operationsand terminating the discharge. Issuanceof a ceaseand desistorder is not a bar against,or a prerequisitefor, taking any other action againstthe industrial user.

(l) Application for a permit required under Subsection(a) must be made to the director upon a form provided for the purpose. (2) The application must contain:

(A) a description of the activities, structures,equipment,and plant processes the on premises,including a list of all raw materials and chemicalsused or stored at the facilitv that are. or could be, dischargedinto the wastewatersystem; (B) the site plans, floor plans, and mechanicaland plumbing plans of the facility with suflicient detail to show all sewers,floor drains, and appurtenances size,location, and elevation, and by all points of discharge; (C) facility; (D) a list of each product produced by type, the amount of the product produced, the process or processes usedto producethe product, and the rate ofproduction; (E) the type and amount of raw materialsprocessed(averageand maximum per day); the number and type of employeesand proposedor actual hours of operation of the

An air break shall be provided between the indirect waste pipe and the tap seal of the waste receptor. or standpipe. 802.3 Waste receptors. Every waste receptor shall be of an approved type. A removable strainer or basket shall cover the waste outlet of waste receptors. Waste receptors shall be installed in ventilated spaces. Waste receptors shall not be installed in bathrooms or toilet rooms or in any inaccessible or unventilatedspacesuch as a closet or storeroom.Ready access shall be provided to waste receptors. 802.3.1 Size ofreceptors. A waste receptor shall be sized for the maximum discharge of all indirect waste prpes' served by the receptor. Such relief vent or fresh air intake shall be canied above grade and shall be terminated in a screenedoutlet located outside the building. 1002.7 Thap setting and protection. in (9) repair holes, cracks,breaks,and loose surfacematerials that arehealth or safety hazards or on floors, walls, and ceilings;and (10) maintain any fence on the property in compliancewith the following standards:

(A) maintain a fence so that it is not out of vertical alignment more than one foot from the inches from vertical, measuredat the top of the fence, for a fence over four feet high, or more than six that this the vertical, measuredat the top of the fence, for a fence not more than four feet high, except provision doesnot apply to a masonrywall unlessthe wall encloses: (i) (ii) (B) a multi-tenant ProPertY;or a single-family or duplex property where the wall is not sharedwith anotherproperty; repair or replacerotted, fire damaged,or broken wooden slats and support posts;

(C) repair or replacebroken or bent metal posts and torn, cut, bent, or ripped metal fencing materials; and (D) repair or replace loose bricks, stones,rocks, mortar, and similar materials on any masoffy wall that encloses: (D (ii) (c) or a multi-tenant ProPertY; a single-family or duplex property where the wall is not sharedwith anotherproperty.

Utiliw standards. An owner shall:

(1) provide and maintain in operating condition connectionsto dischargesewagefrom a structuie or land into a public sewer systemwhere available; connectedto a water sourceand to a (2) provide and maintain in operating condition_a^toilet public sewer,where available, in eactrstructureintended for human habitation; (3) provide and maintain in operating condition connectionsand pipes to supply potable water at adequatepressureto a structureintended for human occupancy; (4) provide and maintain in operating condition a device to supply hot water of a minimum temperatur"bf 120"F. within each structureintended for human habitation; (5) provide and connect a kitchen sink, bathtub or shower, and lavatory to a cold and hot water sourcein each structureintendedfor human habitation; (6) connectplumbing fixtures and heating equipmentthat the owner supplies in accordance with the Dallas Plumbing Code and Dallas MechanicalCode; (7) provide and maintain heating equipmentin operatingcondition so that it is capableof in each room maintaining a minimum inside temperatur. of Og"f . from November 16 through March l5 of a structureintendedfor human occupancy;

(8) if screens not provided as requiredin Subsection (d)(2), provide and maintainin are operating condition, from April I through November 1, refrigerated air equipment capableof maintaining a maximum inside temperaturethat is 20 degreeslower than the outside temperatureor 85o F., whichever is warmer, in eachroom of a structure intended for human occupancy; (9) provide and maintain in operating condition supply lines for electrical serviceto each structureintended for human occupancyif electrical service is available within 300 feet; (10) connect eachheatingand cooking devicethat burns solid fuel to a chimney or flue; and

(11) provide and maintain in operating condition electrical circuits and outlets sufficient to safely carry a load imposed by normal use of appliancesand fixtures. (d) Health standards.An owner shall: (1) eliminaterodentsand vermin in or on the land;

(2) provide a structureintendedfor human habitation with a screenfor keeping out insectsat each opening of the structureif the structureis not cooled with refrigeratedair; (3) maintain the interior of a vacant structureor vacant portion of a structurefree from rubbish and garbage;and (4) keep the interior of a structurefree from insects,rodents,and vermin, except as specified in Section 27-12(b). (e) Securiw standards.An owner or operator of a multifamily property, other than one exempt from registrationunder Section27-30(b)(2)of this chapter,shall: (1) provide and maintain securitydevicesin eachdwelling unit as requiredby Sections92.153, and 92.154, and92.155of the TexasPropertyCode,as amended; (2) if the multifamily property has 20 or more dwelling units, provide security lighting that adequatelyilluminates all parking areas,walkways, stairs and steps,doorways, and garbagestorage areasso that personsmoving in or around those areascan be easily seen. (a) (0 It is a defense prosecution under Subsection of this sectionthat the premisesconcerned is to the site of new constructionand reasonableand continuousprogressis being made to complete the construction. (g) It is a defenseto prosecutionunder Subsection(dX4) of this sectionthat the structurewas treatedto eliminate insects,rodents,and vermin by a person licensedunder the Texas Structural Pest Control Act once within the preceding six months. (h) An owner shall provide a tenant with alternative housing that meetsthe minimum standards required by this sectionwhen: (c)(7) of this section,the (1) after being issueda notice or citation for violation of Subsection owner fails to repair heating equipmentwithin 72 hours after receiving such notice or citation and the overnight low temperature,as measuredby the National Weather Service at Dallas Love Field, is below

(D It is a defense prosecution to under Subsections (c)(7) and (c)(8) ofthis sectionand to the alternativehousing requirementsof Subsection(h) of this sectionthat: (1) failure to-maintain heating and refrigerated air equipment in compliance with those subsections was the direct result of an act of nature or other cauie beyond the reasonablecontrol of the owner; or (2) the owner is making diligent efforts to repair the heating and refrigerated air equipment in compliancewith those subsections; the owner demonstrates the director tiat if to diligent eiforts to repair are being made,the directorwill not issuea notice or citation for a violation oftubsection 1c;12; or (c)(8) of this section. (t) It is a defense prosecution to under Subsection (c)(7) of this sectionand to the alternative housing requirementsof Subsection(h)(1) of this sectionihat a written contract is in effeci ffiiring the tenant to provide and maintain heating equipment and the owner has provided utility connectionsfor heating equipment in compliancewith the Dallas Mechanical Code, as amended,in eachroom of the structureintended for human occupancy. (k) It is a defense prosecution to under Subsection (cX8) of this sectionand to the alternative housing requirement_of Subsection(h)(2) of this sectionittai itrr structureis provided with exterior windows and doors that are easily openableto provide air ventilation and covered with screensin compliance with Subsection (d)(2)of this section. (4) provide solid wastereceptacles containerswhen required by Chapter 18 or of this code; and

(5) not alter a structureor its facilities so as to createa nonconformitywith Section27-ll or this section. (b) The tenant occupantof a single-family residential structure shall keep the interior of the

SUBCHAPTER 3 PERMITS AND INSPECTIONS SECTION301 PERMITS 301.1 Permits required. 301.1.1General. A person,ftrm, or corporation shall not, without first obtaininga permit from the building official: 1. erect,construct, enlarge, to, alter,repair,replace, add move,improve,remove,install, convert, demolish,equip, use, occupy,or maintain a structureor building service equipment;

No building construction or demolition activity, including but not limited to equipment usage,deliveries, on and off loading of materials and storageof materials, supplies, or debris, shall be done on public property or within a public way, except as authorizedby a banicade permit issued by the building official. A baryicade permit is also required for any temporary or part-day blocking of a street or sidewalk. The issuanceof a ba:ricade permit requires the repair or replacement of any public street, curb, sidewalk, drainage structure, or boulevard landscapinglocated within the tanicaded area,oi otherwise damaged during construction or demolition, to equal or better condition than that prior to the start of construction or demolition activities. The owner, agertt,or lesseeof a strucfurehas the duty to ensure that permits are obtained by properly qualified personsbefore work is started,andthe owner, owner's agent, or lesseeshall be subject to the penalties provided in this chapterfor failure to obtain a proper permit.
