BACKGROUND
Since1999,AdelmanhasmaintainedBarkingdogs.org,aninternetweblogwherehereportsonnewsandeventsintheLowestLowerGreenvillecommunityofDallas.OnDecember10,2010,Plaintiffsfiledthisactionalleging,amongotherthings,thatAdelmanpublisheddefamatoryarticlesaboutPlaintiffsonBarkingdogs.org.PursuanttoPlaintiffs'AmendedPetition,thisactionisgovernedbyaLevel2discoverycontrolplan.

DefendantsservedtheirfirstdiscoveryrequestsonFebruary7,2011.OnMarch25,2011,Plaintiffsservedlate,procedurallydeficient,andincompleteresponsestoDefendants'discoveryrequests.Plaintiffssupplementedtheirdiscoveryresponseswithstill-deficientmaterialsonApril25,2011andMay18,2011.OnOctober19,2011,DefendantsnoticedthedepositionofPlaintiffRosalesforNovember2,2011,adatetowhichhiscounselagreed.Rosales,however,didnotshowupforthedeposition,apparentlybecausehewas(andstillis)beingheldinRockwallCountyjailondrug-relatedcharges.RosalesandhiscounselalsoneglectedtoinformDefendants'counselthatRosaleswouldbeunavailableforthedeposition,causingDefendantstoincurunnecessarycostsforadepositionthatPlaintiffsknewwouldnotoccur.Finally,duringthethirteenmonthsthisactionhasbeenpending,Plaintiffshavenot

ARGUMENTANDAUTHORITIES
UnderTexasRuleofCivilProcedure166a(i),DefendantsareentitledtosummaryjudgmentbecausePlaintiffscannotdemonstratethatthereisevidencetosupportanyoftheircausesofaction.Afteradequatetimefordiscovery,adefendantmay,withoutpresentingevidence,moveforsummaryjudgmentonthegroundthatthereisnoevidenceofoneormoreessentialelementsoftheplaintiffsclaims.TEX.R.CIV.P.166a(i)."Thecourtmustgrantthemotionunlesstherespondentproducessummaryjudgmentevidenceraisingagenuineissueofmaterialfact."
