Kyle Brennan’s older brother Sean recounts Kyle’s discovery of Tom Brennan’s Magnum 357 in 2005 countering his assertion that Kyle did not know he possessed the weapon that would kill him. BEFORE NOTARY
 
“I,
Sean Brennan , of 4037, Stratford Lane, in the city of Carpentersville, State of Illinois ,
MAKE OATH AND SAY THAT:” and do hereby certify, swear or affirm, and declare that I am
competent to give the following declaration based on my personal knowledge, unless otherwisestated, and that the following facts and things are true and correct to the best of my knowledge:I have firsthand knowledge regarding Thomas Myles Brennan and a Taurus 357 revolver that he
was in possession of during the time of my younger brother Kyle’s death. Kyle Thomas Brennan
passed away at
Tom’s residence at 423 Cleveland Street, Apt. 4, Clearwater, Florida on February
16, 2007.
I know that Kyle in fact, did have prior knowledge of Tom Brennan’s ownership of the Taurus
357 and knowledge of where Tom Brennan would have stored the weapon ( page 18 of theClearwater Police Report).I grew up in a mostly male household with relaxed boundaries. In my house it was not out of the
ordinary to go into someone else’s room looking for necessary or shared items ( such as t
-shirts,socks, books, magazines, etc.).In 2005/2006 my brother Kyle and I stayed with my step-father Thomas Brennan for anextended period of time. I had just returned to the United States after serving an overseas tour of duty with the U.S. Army. One day Kyle approached me holding a small cloth bag and said that
he had found a gun in his father’s nightstand. Knowing that I had experience with firearms he
asked me if I could identify the manufacturer of the gun. I removed the weapon from the bag andimmediately checked the chamber to see if it contained any live rounds. It did not. I identifiedthe weapon as being a Taurus revolver that was manufactured in Brazil in the 1980's. I kept the

weapon from Kyle, and decided for safety reasons to search the home to make certain that therewas no unsecured ammunition. I found no ammunition in the home.I asked Tom what he was doing with a weapon in his home. He told Kyle and me that the gunhad belonged to his father. I expressed my concerns about him having an unsecured weaponin his home, where he was also renting rooms to individuals without doing background checks.Tom said that he had no ammunition for it and was not planning on purchasing any since he hadno interest in weapons and had no intention of ever firing it.When we were staying in Florida Tom took Kyle and me to a shooting range in Ft. Myers,Florida
called Fowler’s. When we went there we did not take the Taurus 357 from the house butI rented a weapon there, a Heckler& Koch, USP 45 and Fowler’s provided the ammunition.
 
After my brother died and I learned that it was from a weapon in Tom Brennan’s
apartment, I
asked my mother Victoria if in fact he had been killed by his grandfather’s weapon, the Taurusrevolver Kyle had found in his father’s nightstand on that previous visit. I expressed my concern
over when exactly the ammunition was purchased for the weapon as Tom Brennan had told us hehad no interest in ever firing it.My mother said that she would have my older brother Scott ask the detective assigned to the caseto give Tom these questions: When was the ammunition purchased ? Where was it stored in theapartment?
