February9,2012TheHonorableDaveCamp,ChairmanCommitteeonWaysandMeansU.S.HouseofRepresentatives1102LongworthHouseOfficeBuildingWashington,DC20515TheHonorableMaxBaucus,ChairmanCommitteeonFinanceU.S.Senate219DirksenSenateOfficeBuildingWashington,DC20510DearChairmanCampandChairmanBaucus:Wearewritingregardingthepossibleinclusionofspectrumpolicyintheextensionofthepayrolltaxlegislation.Smartspectrumpolicywilldrivethenextgenerationofwirelessbroadband,creatingneweconomicopportunitiesforthetelecommunicationsandtechnologyecosystem.Theseprovisionswillhaveadramaticimpactonournation'swirelessfutureandbenefitmanystakeholders,includingpublicsafety,smalJbusinesses,educators,andconsumers.Whiletherearemanyimportantspectrumpolicygoals,todaywe'rewritingtourgeyoutopreservetheFederalCommunicationsCommission's(FCC)flexibilitytousesomeofthe"beachfront"spectrumrecoveredfromvoluntaryincentiveauctionsforunlicenseduse.Someofthemostsignificantinnovationsinwirelesscommunications,suchasWi-FiandBluetooth,wereborninspectrumbandswithnoexclusivelicense.Collectively,unlicenseddeviceshelpgenerateanestimated$16-37billionperyearfortheU.S.economy.Evenournation'slargestwirelessserviceprovidersuseunlicensedspectrumtoreducecongestionontheirnetwork,withexpertssuggestingthatmorethanone-thirdoftheirdatatraffictodayisoff-loadedontoWi-Finetworks.Exploringtheuseofbeachfrontspectrum,specificallyinthetelevisionband,isvitalgivenitsabilitytopenetratebuildings,enhanceruralcoverage,andcarrymoredatatrafficthantraditionalWi-Fi.Yettoday,withinthefrequenciesbestsuitedformobilebroadbandservices,thereismorethanfivetimesasmuchspectrumavailableforlicenseduseasthereisforunlicenseduse.FromPlumas,CaliforniatoLogan,Ohio,entrepreneursandsmallbusinessesareworkingwithleadersinkeysectorsoftheU.S.economy,suchashealthcare,educationandenergytodevelopwirelesshotspots,medicalpatientmonitoring,smartgridandotherinnovativeapplicationsthatuseunlicensedspectrumfoundinthetelevisionband.Spectrumpolicymustrecognizethatbothlicensedandunlicensedspectruminthetelevisionbandmaximizestheeconomicbenefitsofwirelessbroadband.Withabalancedapproachtospectrumpolicy,wecanunlockbillionsofdollarsinprivateinvestment,newinnovations,jobcreation,andeconomicgrowth.Thankyouforconsideringtheseviews.
