OnSeptember17,2011,amovementnowknownas"OccupyWallStreet"beganinNewYorkCity.ThegoalofthemovementistoprotestandendwealthdisparityintheUnitedStates,thedisenfranchisementofthepoorandmiddleclass,corporatecontrolandinfluenceinpolitics,andtocombatsystemicdiscriminationbaseduponrace,sex,gender,class,nationality,andsexualorientation.OccupyWallStreetdeclaimsthatitisinvolvedinrevolutionaryactivitythatwillfundamentallychangethegovernmentoftheUnitedStates.2.OccupyManchesterisadirectoutgrowthoftheOccupyWallStreetmovementandadherestothesameprinciplesandpoliticalmessage.OccupyManchesteriscommittedtopeacefulandresponsiblerevolutionaryactivity.

doesnotcondoneortolerateanyformofviolence,discrimination,wasteorpublicnuisance.OccupyManchestermodelsthetypeofnewpoliticalparadigmthat
it
seekstheUnitedStatesgovernmenttobecome:itprovidestransportation,food,shelterandmedicalattention;decisionmakingisnon-hierarchical,basedonconsensusbuilding.TheDefendantsareparticipantsinOccupyManchesteranditwasinthatcapacitythatthecurfewandtrespasslawswereappliedagainstthem.3.Thegroupswithinthe"Occupy"movement,includingOccupyManchester,engageinrevolutionaryactivitybymaintaininga24-hourpresenceonpublicpropertyandbyengagingincontinuousanduninterruptedprotectedspeechandassembly.Thecontinuousaround-the-clock,sevendaysaweekphysicalpresenceinpublicspaceisauniqueandcriticalpartofthemethodandmessageoftheOccupyManchestermovement.Thedefendantsassertthatthispresenceisrequiredtodrawattentiontotheproblemsconcerningtheeconomicandpoliticalsystems'failuretoadequatelyaddresstheneedsofthe"99%"whodonotcontrolthemajorityofwealthandpower.

4.TheactivitiesforwhichtheDefendantshavebeencitedareactivitiesthatareprotectedbythefederal,andespecially,bytheNewHampshireConstitutions.TheyhaveassembledpeaceablytoprotestthecooptionofwealthandpowerintheUnitedStatesbythe1%ofthewealthiest.TheybelieveferventlyinthewordsofPart1,ArtlOaftheNewHampshireConstitutionthatgovernmentisinstitutedforthecommonbenefit,protection,andsecurityofthewholecommunity,andnotfortheprivateinterestofthewealthiestclassofmen.Theirphysicalpresenceintentsonpublicland,provid,ingfoodandsheltertothewholecommunityissymbolicofthegovernmentthattheyaspiretobringaboutforthiscountry.TheArrest5.OnNovember20,2011theManchesterPolicetoldthemembersofOccupyManchesterthattheywouldberequiredtoleaveVeteran'sParkinManchester,wherethegrouphadestablishedanencampment.ManyofthemembersofOccupyManchestervoluntarilyleftthepark.TheOccupymemberswhoremaineddividedthemselvesintotwogroups.OnegroupagreedtoleaveuponbeingissuedacitationforviolatingtheCityofManchester'scurfewordinance.Thesecondgrouppolitelyexplainedtothepolicethattheywouldrefusetoobeytheordertoleavetheparkandassertedtheirconstitutionalrighttoremainattheparktoassemble,protest,petitionthegovernment,andengageinactsofpeacefulrevolution,6.EachofthepresentDefendantsiscitedforviolatingManchesterOrdinance96.04PARKOPERATINGPOLICY,whichclosesthepublicparkseverydayoftheyearfrom11:00p.m.until7:00a.m.Aviolationofthisordinancecarriesamaximum$1000fine.7.DefendantsElizabethEdwards,ElizabethGrunewald,BrianKelly,andMatthewRichardswereadditionallyarrestedandchargedwithaviolationofCriminalTrespass(RSA635:2)becausetheyrefusedtheordertoleavethepark.ThisisaClassAMisdemeanor.Allof
