NOTIFICATION No RDPR 16(1)/MGNREGA 2011 Bangalore dated 10.01.2012 ‘Scheme Implementation of Social Audit Rules 2011 in Karnataka \Whereas Government of Inia enacted the National Rural Employment Guarantee Act 2005 dated 07.09.2005 and framed ‘Audit of Schemas Rules 2011 on 30.06.2011, in exercise of powers confered in sub-secton(t) of section 24 of MGNREGA 2008. ‘Whereas the rule 3 ofthe sald notation makes it compulsory to State Governments to nol the Social Audt Scheme Rules 2011, in exercise of the powers conferred under section 32 of MGNREGA 2005, the Government of Kamataka hereby make and notiy the following Scheme implementation of Social Audit in Karnataka, |. Shortitle and commencement 1. Those rules may be called the MGNREGA Scheme Implementation of Socal Aut rules 2011 in Karnataka, 2. For the purpose ofthese rules, aut of schemes shall inctude social audit 3. LITY OF PROGRAMME OFFICER AND EX-OFFICIO EXECUTIVE OFFICER, ‘The Programme Officer shall ensure that all required information and records of all Implementing Agencies such as, Job card Register, Employment Register, Work Register, Grama Sabha Resoluion, Copies of sanctions (Administrative or ‘Technical or Financial), Work Estates, Work commencement Order, Muster Roll issue and Receipt register, Mustr Rol wage Payment Acquaintance and order, materials -bile and vouchers (for each work) Measurement Books, Asset Register, Action Taken Reports on previous Social Audis, Grievances or Complaints Register, any other dacuments that the social aut unit requires to conduct the social audit process are properly collated inthe requisite formats and provided, ‘along with photocopies, to the social Audit Unit by facilitating conduct of socal audit at least fiteen days, in advance of the Scheduled date of meeting ofthe Grama Sabha conducting social audit ‘To prepare a summary of ndings of social audits conducted during financial year ofthe respective Taluk ‘To monitor the Action taken on Social aut and prepare Action Taken Reports of the respective Taluk Ensure that corrective action is taken on the Aust Report 9, ROLE & RESPONSIBILITY OF PANCHAYAT DEVELOPMENT OFFICERISECRETARY (HE WILL ACT AS IMPLEMENTING OFFICER) a) » 3 * ° ® ‘The Panchayat Development officer shall funish that all raquired information and records ofall Implementing Agencies such as, job card Register, Employment Register, work Register, Grama Sabha Resolution, Copies of sanction (Administrative or Technical or financial), Work Estimates, Wark Commencement Order, Muster Roll Issue And receipt register, Muster Rol, Wages Payment Acquaintance and order materials bill and vouchers (for each work ) Measurement Books, Asset Register, Acton Taken Report on previous Social Audits, Grievances or Complaints Register, any other documents that the social audit unt requites to conduct the social audit process are properly colated in the requisite formats and providing, along with photocopies, to the Social Auct Unit of facitating conduct of social audit at least teen days in advance ofthe scheduled date of meeting ofthe Grama Sabha conducting social audit, To prepare a summary of findings of aust conducted during fnancial year ofthe GP. ROLE of NGO 41) The Directorate should explore the possibilities of engaging the NGO on the flowing issues. 2) Capacity building ») Facittaing the Grama Sabha and Public hearing. €)As Independent abserves. 6) Identtying training needs of stake holders. ©) Publicity 2) The Directorate shall also bring out general guidelines in identiying and engaging the NGO's. IV Duration of Social Audit: ‘Social Audit shal facilitate conduct of the works taken info under the Act in every Gram Panchayat atleast once in si ‘montis inthe manner prescribed under thse rules. 1. The expenelture incurad during the financial year for the period commencing from April to Seplamber, be subjected to the social audit to be conducted in the period commencing from October to March, 2. The expenditure incurred during the financial year forthe period commencing from October to March be subjected to the social audit to be conducted inthe period commencing from Apri to September. 3. Accordingly Director has to prepare a calendar forthe socal aul to be under taken in the beginning ofthe financial year. V Social Audit Facilitation. Social Audit unit is responsit le for the following namely: (2) Build capacities of Gram Sabhas for conducting social audit; and towards this purpose, identify, train and deploy suitable resource persone at vilage, block, district and State level, drawing from primary stakeholders and other civil society organizations having knowledge and experience of working forthe rights of the people. (b) Prepare social aut reporting formats , resource material, guidelines and manuals fr the socal aut process: (c) Create awareness amongst the labourers about their rights and entilements under the Ac (€) Faciitate verification of records with primary stakeholders and work sites; (e)Faciitate smooth conduct of social aut Gram Sabhas for reading out and finalizing decisions after due discussions: () Host the socal auc reports including action taken reports inthe public domain. VI Process of conducting social audit:- 41) The Social Aucit Unit shall, atthe beginning ofthe year, frame an annual calendar to conduct atleast one social aut in leach Gram Panchayath every six months and a copy of the calendar shall be sent to all the District Programme Coordinators of making necessary arrangements. 2) For facttating conduct of social audit by Gram Sabha, the resource persons daployed by Social Audit Unit, along with primary stakeholders shall veity- ) The muster rolls, entry and payments made in the specied time period, by contacting the wage seekers whose names are entared in such muster rls li) Tre work ste and assess the quantity wth reference to records and also quay of work done; ii) The cash book, bank statements and ather financial records to verify the correctness and reliability of financial reporting: ») The invoices, bills vouchers of other related records used for procurement of materials to testy such procurement \was as per the estimate, as per procedure laid dawn and was economical ») Any other payment made by the implementing agency from the funds ofthe scheme, cmd, # 3, Thome, FyRS 2, 2002 i age meat an - VS g 3) The labourers andthe vilage community shall be informed about the Gram Sabha conducting socal audit by the resource persons as well asthe programme Officer to ensure ful participation. 4) To conduct social aust process, a Gram Sabha shall be convened to discuss the findings of the verification exercise and ‘also the review the compliance on transparency and aecountabilty, fulfilment ofthe rights and entilements of labourers ‘and proper utilization of funds. '5) The information shal be collected and read over in Grama Sabha in the preserived format wi Social Audit Grama Sabha 4 Social Audit in a Gram Panchayat takes place for 6 days. Day ONE: ‘Training of GP Resource persons by Taluk Resource Persons. Day TWO: CGrampanchayat Resource Persons to conduct door ta door survey and verify the details & payment as per Job Card and gathering ther information. DayTHREE & FOUR: Physically visiting the works and obsorvng the quality, Work Site Factos. Day FIVE: Proparation of Report Day Six: Grama Sabha and Public Hearing, > Atthe end of the Social Auct finding of the Social Auct should be presented to the Grama Sabha for discussion. Public hearings shall be conducted in Grama Sabha > The process of Grama Sabha should be video recorded. Social Audit Grama Sabha is entirely eiferent from the Grama Sabha defined under KPR Act 1993 and shall be presided over by the officer noted by OPC. Provided the same officer shall not be notified tothe same Panchayat for successive Social Audit Grama Sabha, Parson presiding with the consent of Grama Sabha may refer the primafacie cases & fraudlembezziement to Ombudsmen, (Ombudsmen shall dispose these cases as por aw. ‘ill Obiigation of certain persons in relation to social Audit, 1) The programme Officer shall ensure that all the required information and records of allimplamenting agencies such as, Job card register, Employment rogister, Werk Register, Gram Sabha Resolution, Copies of the sanctions (Administrative or ‘Technical or Financial), Work Estimates, Work Commencement Order, muster-ll Issue and receipt register, muster Rolls, ‘Wage payment Acquaintance & order, Materials -Bils and vouchers (lor each work), Measurement Books (foreach work) ‘Asset Ragister, Action Taken Report on previous social audits, grievance or complaints register, any other documents that the Social Ault Unit requires to conduct the social auelt process are properly collated in the requisite formats; and provided, along with photocopies, to the Social Audit Unit for faciitating conduct of social audit at least fileen days in ‘advance ofthe scheduled date of meeting ofthe Gram Sabha conducting Social audit. 2) The information referred to in gub-rule (1) shall be publically available at the same time and the photocopies shall be ‘availabe at nominal cost. 3) Every Distt programme coordinator or any oficial on his behalf, shall. 2) Ensure that all records for conduct of social aucit are furnished to the Social Audit Unit by implementing agencies through the Programme Officer, wanes ane, upd 2, 2009 038, 'b) Ensure that corrective action is taken on the socal aut report ©) Take stops to recover the amount embezzled or improperty ulized; and issue receipts or acknowledgement for ‘amount so recovered, 4) Pay wages found to be misappropriated within seven days of the recovery of such amount to the wage seekers. 2) Maintain a separate account for amounts recovered during the sacal audit process Ensure that the appropriate action (including inating criminal and Chil proceedings or termination of services) is Intated against individual or class of individuals or persons who misullised or embezzled the amount meant for the schemes under the Act 1X Post Social Auait Processes: ‘The DPC & PO are responsible to take follow up action on the findings of Social Audit Gram Sabha vide Prakarana No:14(3)(E) & 15(65)(0) of MGNREGA. 41) Social audit reports shal be updated in MIS by Taluk Social Audt Resource person, 2) Taluk Resource person to submit socal Audit reports to Programme officer, DPC, Resource Persons DistictState, 3) Follow up action about Social Audit 44) Action taken report shall be placed before in next socal audit 5) The Directorate shall post the decision of the Grama Sabha and Puble hearing of each Grama Sabha on the offcial Website in the prescribed fommat 16) Action taken report shall be uploaded to the Website by the appropriate authority ‘By order and inthe name of the Governor of Karnataka, DR.AMITA PRASAD, Principal Secrotary to Government PRS Rural Development & Panchayat Raj Department FER Aémest Hoste, 2 LaRtaxt 2012 dom (9395 Ae BASIS sete
