DearChairmanCampandRankingMemberLevin:Forthepastthirtyyears,CongresshasprovideddedicatedfundingforhighwayandtransitprogramsthroughanexcisetaxongasolinededicatedtotheHighwayTrustFund.Thisfundingstructurehassuccessfullyprovidedhighwayandtransitprogramswithsecure,dedicatedrevenuesandbudgetaryfirewallsdatingbacktotheReaganadministration.Thesuccessofthisapproachiswithoutquestion:TheTrustFundhasbeencriticaltoournation’sabilitytobuildanefficientandmultimodaltransportationsystem.Withrecordtransitridership,nowisnotthetimetoeliminateguaranteedfundingforournation’spublictransportationsystems,whichsavedAmericanscloseto$19billionincongestioncostsin2009.Forthefirsttimeinthirtyyears,thependinglegislationH.R.3864,theAmericanEnergyandInfrastructureJobsFinancingAct,removesthecertaintyofacontinuedrevenuesourceforourtransitsystemsaswellastheCongestionMitigationandAirQualityProgram.Specifically,wearedeeplyconcernedabouttheprovisioninH.R.3864thatwouldterminatefundingfromtheexcisetaxongasolineandreplaceitwiththeAlternativeTransportationAccount.Inplaceofgasolinetaxrevenues,thelegislationwouldprovideaone‐time$40billiontransferofGeneralFundrevenuestotheAlternativeTransportationAccount.NotonlyisthisleveloffundinginsufficienttofullyfundtheproposedauthorizedlevelsfortheAlternativeTransportationAccount,butitwouldsubjecttransitandCMAQfundingtotheannualappropriationsprocess.Thischangewillmakeitimpossibleforpublictransitsystemsacrossthecountrytoplanforthefuture.ItwillalsomakeitimpossiblefortheFTAtohonorgrantagreements.Inaddition,thislegislationdoesnotmakeclearhowthe$40billioninGeneralFundrevenueswillbeoffsetintheU.S.budget.Asaresultofthisfundinggap,weareconcernedthatthe$40billiongeneralrevenuetransfermaynotoccurleavingtransitprogramsoutinthecold.WestronglyencouragetheCommitteetorejectH.R.3864andworktocontinuetofundhighwayandtransitprogramsthroughdedicatedfunding.Sincerely,
