Bythispetition,LightSquaredaskstheCommissiontoresolvetheregulatorystatusofunlicensedcommercialGlobalPositioningSystem("GPS")receiversvis-a-visLightSquared'slicensedoperationsinthe1525-1559MHzMobile-SatelliteService("MSS")band.Afteryearsofplanningandbillionsofdollarsininvestment,LightSquaredispreparingtocommencecommercialserviceoveranintegratedsatelliteandterrestrial4GLTEwirelessnetworkusingthisMSSspectrum=-consistentwithCommission-mandatedmilestonesrequiringLightSquaredtoprovideacompetitive4GLTEbroadbandcapabilityto100millionAmericansbytheendof2012and260millionAmericansbytheendof2015.
It
recentlyhasbecomeapparentthatthecommercialGPSindustryhasmanufactured,andsoldtounsuspectingconsumers,unlicensedandpoorlydesignedGPSreceiversthat"listen"forradiosignalsbothinthe"RNSS"frequencybandinwhichtheU.S.GPSsystemisintendedtooperate,aswellasacrosstheadjacent"MSS"frequencybandthatis
not
intendedforGPSuse,andinwhichLightSquaredislicensed.ThecommercialGPSindustryclaims,withoutjustification,thattheseGPSreceiverssomehowareentitledto"protection"fromtheLightSquaredauthorizedoperationsthatoccurentirelywithintheMSSband.TheGPSindustryalsoclaimsthatLightSquaredmustalteritsplansinordertoaccommodatethesecommercialGPSreceivers,andhasdemandedthatLightSquaredabandontheuseoflargesegmentsoftheMSSbandinwhichLightSquaredislicensed.
It
doesnotmatterwhethertheCommissioncharacterizescommercialGPSreceiversasunlicensedreceive-onlyearthstationsthatoperateunderPart25oftheCommission'srules,orasunlicenseddevicesthatoperateunderPart15oftheCommission'srules.Therelevantprecedentundereitheranalysisreachesthesameinescapableresult:unlicensedcommercialGPSreceiverssimplyarenotentitledtointerferenceprotectionfromLightSquared'slicensedoperationsintheMSSband.Moreover,thecommercialGPS
 
industryismistakenthatLightSquaredmustbearthefinancialburdenresultingfromthefailureofthecommercialGPSindustry,foralmostadecade,toaccountforthedeploymentofLightSquared'snetworkinthedesignandmanufactureofcommercialGPSreceivers.LightSquared'splannedoperationsintheMSSbandarefullyconsistentnotonlywithitslongstandinglicense,butalsowiththeU.S.TableofFrequencyAllocations,theCommission'sservicerules,andthetechnicalstandardsdevelopedoverthepastdecadewiththecooperationandsupportofthecommercialGPSindustryitself(includingapplicablelimitsonLightSquared'sout-of-bandemissionsintotheRNSSband).Incontrast,commercialGPSreceiversarenotlicensed,donotoperateunderanyservicerules,andthusarenotentitledtoanyinterferenceprotectionwhatsoever.Moreover,acommercialGPSreceiverthat"listens"intheMSSbandrepresentsanonconforming(anddoublyunprotected)useofspectrumthatisinconsistentwiththeU.S.TableofFrequencyAllocations.ThecommercialGPSindustrythereforehas
no
basisforclaiming"protection"foritsunlicensedreceivers,orforassertingthatLightSquared'soperationswouldcausecognizable"harmfulinterference"tocommercialGPSreceivers.TotheextentthatcommercialGPSreceiversarenotfullycompatiblewithLightSquared'splannedoperationsintheMSSband(whichisadjacenttotheRNSSband),itshouldbeapparentthattheGPSindustrysimplyhasfailedtoprepareitselfforATCdeployment.AstheCommissionhaslongrecognized,thetypeofreceiver"desensitization"or"overload"concernsthatgiverisetothispetition-theinabilityofGPSreceiverstoadequately"reject"thereceptionofsignalsintheadjacentMSSband-shouldnotbeblamedonthelicenseeintheadjacentband(LightSquared),because"overload"is"basicallyareceiverdesignproblem"thatiswithinthecontrolofthecommercialGPSindustry.WhilethedeploymentofterrestrialtransmittersintheMSSbandhasbeenexpectedforalmostadecade,thecommercialGPSindustryhasfailedtotakethateventualityii
