The UNITED STATES OF AMERICA, by its attorney, PATRICK J. FITZGERALD, UnitedStates Attorney for the Northern District of Illinois, respectfully submits this written proffer,pursuant to Fed. R. Evid. 801(d)(2)(E), and
United States v. Santiago
, 582 F.2d 1128 (7th Cir. 1987),of the government’s evidence supporting the admission of certain co-conspirator statements againstdefendants at trial.
I.INTRODUCTION
This submission begins by providing an overview of the conspiracy in this case. It thendiscusses the law governing the admissibility of coconspirator statements under Fed.R.Evid.801(d)(2)(D), and outlines some of its evidence establishing the conspiracy. Finally, it summarizesevidence supporting the admission of coconspirators’ statements pursuant to Rule 801(d)(2) and forwhich a pre-trial ruling by the Court is requested, in accord with
United States v. Santiago
, 582 F.2d1128, 1130-31 (7th Cir. 1978), and established practice in this Circuit.

585 F.3d 394, 398, 400 (7th Cir. 2009).This proffer does not list all of the government’s witnesses and the evidence each willpresent, nor does it provide all of the evidence that will be presented by those witnesses who arenamed. Rather, the proffer is a summary only, offered for the limited purpose of establishing theexistence of a conspiracy by a preponderance of the evidence and providing defendants withadequate notice of the nature of the conspiratorial evidence, including the nature of co-conspiratorstatements made in furtherance of the conspiracy that the government will offer at trial. Bypresenting statements attributed to particular witnesses, the government is not committing to calleach of the witnesses, nor is the government committing to introduce each statement containedherein.
