("Countdown").ThedefamatorystatementsdescribedbelowwerebroadcastwithintheStateofNewJersey.2.DefendantKeithOlbermannisanemployeeofCurrentMedia,servesastheHostofCountdownandisCurrentMedia'sChiefNewsOfficer.Mr.OlbermannisresponsibleforthecontentbroadcastonCountdown.3.DefendantDavidShusterhostedCountdownasanemployeeofCurrentMediaon

February24,2012.4.OnFebruary24,2012,duringthevideobroadcastofCountdownontelevision,DavidShuster,whileactingasanemployeeorothertypeofagentofCurrentmedia,calledPlaintiffJamesO'Keefe,IIIa"convictedfelon."Thisstatementwasnottruewhenmade;itwasmadewithknowledgeofitsfalsityorarecklessornegligentdisregardforitstruth,andconstitutesslanderandslander
perse.
ThisstatementhasbeencontinuallybroadcastonCurrentMedia'swebsitesincethetelevisionbroadcastaired.5.OnFebruary24,2012,duringthevideobroadcastofCountdownontelevision,DavidShusterstatedthatthereisa"rapeallegationfacing...conservativeactivist...JamesO'Keefe,"referringtoPlaintiffandcertainallegationsmadebyNadiaNaffeatamunicipalcourtprobablecausehearinginWestwood,NewJersey.AtranscriptofthathearingisattachedheretoasExhibitA.Thisstatementwasnottruewhenmadeandhasbeencontinuallyre-broadcastonCurrentMedia'swebsiteandhasbeenrepeatedinprintonCurrentMedia'swebsitesincetheoriginaltelevisionbroadcastaired.Thestatementsreferredtointhisparagraphweremadewithknowledgeoftheirfalsityoranegligentorrecklessdisregardfortheirtruthandconstituteslanderandslander

broadcastinprintandvideobyCurrentMediaandOlbennann.Thesestatementswerenottruewhenmade,weremadewithknowledgeoftheirfalsityorarecklessornegligentdisregardfortheirtruth,andconstitutelibel,libel

AttachedasExhibitBisacopyofapleadingfiledinthecriminalactionarisingfromtheincidentatSenatorLandrieu'sofficereferredtobyOlbermanninthestatementsabove.Inthispublicdocument,theGovernmentspecificallystatesthatdespiteitsinvestigation,itfoundnoevidencetendingtoshowthatPlaintiffintendedtocommitanyfelonyortotamperwiththeSenator'sphonesystem.PlaintiffwasneitherchargedwithnorconvictedofafelonyarisingfromtheincidentinvolvingSenatorLandrieu.8.OntheDecember
