TheHonorableReincePriebusChairmanRepublicanNationalCommittee310FirstStreet,SEWashington,DC20003Re:RequestforInvestigationofMichiganRepublicanPartyAllocationofDelegate(s)DearChairmanPriebus:PleaseacceptthisletterasaformalrequestonbehalfofRickSantorumforPresidentforaninvestigationbytheRepublicanNationalCommittee's(RNC)GeneralCounselintothereversalofdelegateallocationrulesbytheMichiganRepublicanPartyfollowingthe2012MichiganRepublicanPresidentialPrimaryheldonFebruary28,2012.WerequestaninvestigationintotheMichiganRepublicanStateCommitteeandanyindividual,campaign,orentityinvolvedinthereallocationdecision(s).AfterreviewingtherulessetforthbytheMichiganRepublicanPartyandtheresultsoftheFebruary28,2012primary,itwasclearthatthestate'sat-largedelegateswouldbeproportionallydividedbetweenSenatorSantorumandGovernorRomney-eachreceivingoneat-largedelegateasaresultoftheFebruary28,2012primarycontest.Thesequenceofrulemakingdictatingtheallocationofdelegatesisasfollows:1.OnAugust13,2011,theMichiganRepublicanStateCommittee(MRSC)overwhelminglypassedacomprehensivesetofRulesgoverningthemethodtobeusedforthePresidentialNominatingProcess.ThisvotewastheresultofalengthyprocessthatbeganinaspeciallyformedtaskforcethatwasdesignedtotakestatewideinputfromRepublicans,andmakearecommendationtothePolicyCommittee.ThePolicyCommitteeisthestandingsub-committeeoftheMRSCinwhichalmostallConvention,By-Laws,andotherRule-relatedmattersbegin,beforetheyareaddressedbythefullMRSC.ThePolicyCommitteeworkedtodraftfinalrecommendationsforthefullMRSCduringthesummerof2011,makingitsfinalpresentationinAugust.

TheHonorableReincePriebusMarch2,2012Page22.ThemethodofelectionthatwasadoptedonAugust13,2011wasaStateofMichiganadministeredPrimary.IntheseRules,theMRSCalsoaddressedanumberofotherissues,includinghowtheDelegateswouldbeawarded.3.Rule19coversmattersrelatedtotheElectionandAllocationofNationalConventionDelegates.Specifically,Rule19C.(2)contemplatesaThresholdVoteof15%,andProportionalAllocationoftheat-LargeDelegatepositions.Thecalculationasspecifiedin19C.(2)dictatesthattherawvotetotalsofthecandidateswhomeettheThresholdVoteof15%oftheStatewidePresidentialPreferencePrimarybecalculatedasapercentagetodeterminetheproportionalallocationoftheat-LargeDelegates.Whenthiscalculationresultsinafractionalnumber,itisroundedupordowntothenearestwholenumber,with.5orhigherbeingroundedup,and.5orlowerbeingroundeddown.4.InaMemorandumdatedFebruary7totheRNC,whichwassentbyMichiganRepublicanChairmanBobbySchostaktoallmembersoftheMRSConFebruary22,2012("theMemorandum"),theCredentialsCommitteeprovidedfurtherclarificationrelatedtotheappropriatecalculationsintheeventthepenaltycontemplatedbytheRNCwasapplied.ThisMemorandumaspresentedwasconsistentwithallpublicdiscussionsheldbytheMRSCduringitspreviousgeneralsessionsanddebateonthesetopics,andwasconsistentwiththehistoricalapplicationoftheproportionalityofDelegateapportionment.5.TheMemorandummakesclearthreeimportantpoints:Atthebottomofpage2,andtopofpage3,itdenotesthatnoamendmentsarebeingmadetotheAugust13,2011Rules,andthattheRepublicanNationalCommitteehasthereforedeterminednowaiverisneededinacceptingtheMemorandumfromtheCommittee.(AnactualamendmentsubmittedinFebruaryof2012,wellpastthedeadlinesestablishedintheRNCRules,wouldhavenecessitatedawaiverfromtheRNC.)Inkeepingwiththeprinciplethatnoamendmentsarebeingmade,theMemorandumfurtherdetailsatthetopofpage3that"MichiganwilladheretoRule19oftheStateRulesascloselyaspossible."FurtherkeepingwiththealreadyestablishedfactthattheMemorandumisnotanamendmenttotheRules,theMemorandumclarifiesthatthemethodofapportioningat-Large"officiallyrecognizedDelegates"willbethesameasiftherewerenotanyDelegateswhoarenot"officiallyrecognized".Thisisaccomplishedbymerelysubstituting"two"for"fourteen"inRule19.Thelanguagefrom19C.(2)regardingat-LargeDelegatesisasfollows:
"Withrespecttoat-largedelegatesandalternates,pleasenotethatabsentapenaltyfromtheRepublicanNationalCommittee,Michiganisentitledtofourteen(14)at-largedelegatesandalternates.AccordingtoRuleNo.19C(2).oftheStateRules,at-largedelegatesandalternatesare
