GovernmentOperationsandEstimatesCommitteeandHerMajesty'sLoyalOpposition'scriticfortheCanadianWheatBoard.5.RackNineoperatesafor-profitbusinessandisaserviceproviderofvariousinternetandphoneservices.Inparticular,RackNineprovidesanautomatedvoice-overIPrecordedmessagedialingservicethatenablesrapidandlarge-scaleremotetelephonecontact.RackNineprovidesservicestocustomersintheCityofEdmonton,intheProvinceofAlberta,nationallyacrossCanadaandinternationally.AlloftheservicesprovidedbyRackNinearelegalinCanadaandRackNinehasabidedbyallprovincialandfederallawsinitsoperations.6.Duringthe2011Canadianfederalgeneralelection,RackNineprovidedmarketingservicestoanumberofelectioncandidatesacrossCanada.RackNineisanon-partisanentityandhasnoformalpoliticalrelationshipwithanyregisteredpoliticalpartynordidithaveaformalorganizationalrelationshipwithanyfederalcandidateforelectioninthe2011Canadianfederalgeneralelection.Since2007,RackNinehasprovidedautomateddialingmarketingservicestovariousorganizations,bothcorporateandpoliticalincludingmorethanten(10)politicalpartiesinseven(7)provincesandaterritory,aswellascandidatesforcivicoffice.7.Followingthe2011Canadianfederalgeneralelection,RackNinewascontactedbyElectionsCanadainregardstoallegationsthatacustomerofRackNinemayhaveusedautomateddialingservicesprovidedbyRackNineinamannerthatcontravenedthe
ElectionsAct.
AninvestigatorforElectionsCanada,AIMathews,servedaProductionOrderonthePlaintiffsonNovember23,2011.RackNinefullycooperatedwithalloftherequestsmadebyElectionsCanadaduringthecourseoftheirinvestigationasspecifiedclearlyintheProductionOrderofNovember23,2011.NeitherMeiernorRackNinewerethesubjectofElectionCanada'sinvestigation,asspecificallystatedintheProductionOrder.NeitherMeiernorRackNinehaveeverbeenchargedwithanyoffenceunderthe

Defamation8.OnFebruary23,2012,Martin,speakingonhisownbehalfandonbehalfoftheNDP,heldanationallytelevisedpressconferenceintheNationalPressTheatreintheCityofOttawa,intheProvinceofOntario("PressConference").AtthatPressConference,Martinspoke,orcausedtobepublished,statementsdefamatoryofthePlaintiffs'namesandreputations,whichdiscreditedthePlaintiffsandcauseddamageandlosstoMeier'sbusiness,RackNine.Martin'swordsweredefamatory,and,intheveryleast,carriedtheinnuendothatMeierand/orRackNinehadcommittedcriminalactivity,fraudulentactivity,participatedinaconspiracy,intimidation,sabotageand/ordeceit.Infact,MartinmentionedRackNineonseven(7)occasionsandMeierdirectlyinanapproximatefiveminutepreparedstatementthatincludedthenamesofnootherindividualsorbusinesses.Theparticularsofthedefamatorystatementsinclude:a."ElectionsCanadastatedthatthesephonyphonecallsdeliberatelydisrupted..thevotingprocess.Nowhowwasthisdifferentfromabunchofgoonswith
