AttorneyTomWilsoninAppleton.AccordingtothecriminalComplaint,therearefiveseparatechargesofFailuretoPaypersonaltaxestothestateofwisconsinin1988and1989.ThepatientstatedthatonJuly7,1994,hewasdetainedinaswissprisoncalledduBoisMarietalinLausanneSwitzerland.HewasheldthereuntilNovember17,1993,andthenextraditedtoNewYorkCity.HesawJudgeAlyceRoss,afederaljudgeoftheeasternNewYorkdistrictwhodismissedthechargewithprejudice.Hestatedthatthentherewas

faxdetainerfromWisconsin,sohewasflowntoDanecountyJailonDecember13,1993,HewasheldintheBrooklynHouseofDetentionbetweenNovember19andDecember13,1993.DuringhisstayintheDar.eCountyJail,hehashadseveralhearings.HealsohadevaluationforcompetencyattheMendotaMentalHealthInstituteontwoseparateoccasions--thefirstbeingFebruaryof1994.Hestatedthataletterwassentbacktocourtsayinghewascompetent.Hewasevaluatedthereagaintendaysago,againfoundtobecompetentbut,whenherefusedtoenteranAlfordPlea,hisattorneyfelthecouldnotcooperateand,therefore,thefindingofincompetencywasmade.Duringhi.stimeintheDaneCountyJail,thepatienthasaskedforprivateattorneysbuthasbeengivenpublicdefenders.Heclaimsthat

fouryearsinthelat~1960s.Menta1statusatthetimeofadmissionshowedqheavy-set,baldingmanwhowasorientedtoperson,place,time,andreasonforbeinghere.Hismemorywasexcellentasascertainedbyhismemoryofphonenumbers.HisspeechwaslJgical,coherent,andgoaldirectedwithsomepressure.Hestutteredmildlywhenspeakingrapidly.Hedenieddepressionandstated

hisappetitewasgood.Hewassleepingabouteighthourspernight.Hedeniedhallucinations,thoughtbroadcasting,andthough~insertion.Hestatedthathewasconcernedabouthislegalcaseandwasconcernedaboutsuchthingsasalackofpre1iminaryhearing,buthedidnotexpressanyspecificdelusionalideationexceptforthepossibilitythattherewasnotmedicationinhisfoodinswitzerland.Hisprovisiona1diagnoseswere:Axis.I1.NoMentalDisorder.2.RuleOutDelusionnlDisorder.3.RuleOutHypomania.NoDiagnosis.Obesity.AxisIIAxisIIIMr.Wanta'sadjustmenttothehospitalhasbeenexcellent.Hehasremainedpleasantandcooperative,participatinginallactivities,andengaginginconversationsandtablegamesandcardgameswithotherpatients.Heisoftenabletocalmotherpatientsdownandfocustheirattentionsawayfromtheirproblems.Hehassleptwell.Hehasbeenmovedtoaminimum-securitywardandhascontinuedtomaintainhispleasant,cooperativebehaviorwhilethere.Itistheimpressionofthetre~tmentteamthatMr.wantashowsnoevidenceofmentalillness.Theonlypossiblepsychiatricproblemhecouldhavewouldbedelusionaldisorder.WehavehadaccesstoDr.Mays'letterwhichstatedthesamefindings.Carolslapinski,
