A.HawaiiRevisedStatutes
§338-13
doesnotrequirethattheDepartmentfurnishPlaintiffwithacertifiedcopyoftheoriginalBirthCertificateofVirginiaSunahara.
PlaintiffsreplybeginswithadiscussionoftheroleofthecourtregardingstatutoryconstructionbecausehisprimaryargumentisthatDefendantshavenotproperlyinterpretedHawaiiRevisedStatutes("HRS")§§338-13and338-18,thusitisuptotheCourttoprovideaproperinterpretation.PlaintifffocusesonHRS§338-13(a)whichprovides:(a)Subjecttotherequirementsofsections338-16,338-17,and338-18,thedepartmentofhealthshall,uponrequest,furnishtoanyapplicantacertifiedcopyofanycertificate,orthecontentsofanycertificate,oranypartthereof.

PlaintiffarguesthatheisentitledtoacertifiedcopyoftheoriginalBirthCertificateofVirginiaSunaharabecausetheplainandunambiguouslanguageofHRS§338-13(a)requirestheDepartmenttofurnishanyapplicantacertifiedcopyof"anycertificate"andacertifiedcopyoftheoriginalBirthCertificateofVirginiaSunaharais"anycertificate."(EmphasisaddedbyPlaintiff).Plaintiffclearlyfailstoreadthestatuteinitsentiretyforitprovidesthat"anycertificate,orthecontentsofanycertificate,oranypartthereof'shallbefurnishedbytheDepartmentuponvalidrequestandthenprovidesinsubsection(b)thatcopiesofthecontentsofanycertificateshallbeconsideredforallpurposesthesameastheoriginal.PlaintiffarguesfortheCourttofollowtheplainandunambiguouslanguageofsection338-13(1).ThereisnothingintheplainandunambiguouslanguageofthestatutethatrequiresDefendantstoprovidePlaintiffwithacertifiedcopyoftheoriginalBirthCertificateofVirginiaSunahara.

fact,itplainlyandunambiguouslyallowstheDefendantstoprovidethecontentsofanycertificate,whichiswhatDefendantsprovidedtoPlaintiff.
B.Theword"or"inHRS§338-13(a)doesnotmean"and."
Plaintiffalsoarguesthattheuseoftheword"or"inHRS§338-13(a)doesnotgiveDefendantstheoptionofprovidingacomputergeneratedabstractinsteadofacertifiedcopyofVirginiaSunahara'soriginalBirthCertificate.PlaintiffcitestoHRS§1-18tosupporthispositionthattheword"or"inHRS§338-13(a)mustbeinterpretedas"and"therebyrequiringDefendantstofurnishhimwithacertifiedcopyofVirginiaSunahara'soriginalBirthCertificate.Memorandumatp.7.However,theHawaiiSupremeCourthasheldthatalthough'or'maymean'and'underthepropercircumstances,thecommonusageoftheword'or'isasadisjunctive,indicatinganalternative.
