How to Avoid a Ponzi Scheme


I feel that a little skepticism is healthy. As Ronald Reagan said, Trust, but verify. At least a couple a times a year, Im asked by a prospect, How do I know you arent a Bernie Madoff? We live in uncertain times and this question is often in the back of peoples minds. For our readers today, on the soon-to-be anniversary of Madoff pleading guilty of defrauding almost $65 billion from charities, institutions, and investors, allow me to point out some ways you can not only avoid a Ponzi scheme but protect your cash. Before we get to Madoff sized schemes, here are a couple of basic RED FLAGS. If someone wants you to invest money with them, but they arent listed in the phone bookRed Flag. If someone always comes out to your house, but doesnt have a building or permanent addressRed Flag. If someone always contacts you, but you can never contact them...Big Red Flag. If someone isnt listed with the BBB (Better Business Bureau), SEC, FINRA, or the State Department of InsuranceBIG RED FLAG! Hopefully, these first little tidbits protect you from your simple schemers. However, when were talking about $65 billion, there are lessons to be learned here, too. First, Bernie did not promise spectacular short-term investment returns. Instead, his investors phony account statements showed moderate, but consistently positive returns even during turbulent market conditions. I read where Bernies phony account statements were showing a consistent 1% per month or 12% per year return on average. This is a Big Red Flag playing upon our desire to get rich. Ive been in the financial planning industry for 27 years, and I have never met anyone who is consistently returning 12% a year as a financial planner. These promised high returns seem too good to be true, and thats because they are too good to be true. Second, Bernie asked clients to write out checks to his business or specifically out to him. This is a HUGE RED FLAG. With us, you will never write a check out to me or my business name. All checks are written directly to the custodian. For fixed investments, this is usually an A-Rated Insurance Company, and for variable investments, we use Fidelity Investments as our custodian. You should never write an investment check directly to the business or business owner. Finally, as far as I can tell, Bernie didnt determine suitability with his clients. When you invest with us, well take at least one hour or more to gather background information about your financial health. We do this to protect you and your money, but we also want to make sure that our recommendations are suitable for your financial situation. We will never take the last dollar from a widow whos hoping for big gains to offset her Social Security Income. Furthermore, the fixed and variable companies we partner with avoid those high risk, unsuitable situations as well. In other words, if you come across someone who will take your money without any questions asked, buyer beware! I hope the above helped you. I dont mind being asked if Im a Bernie Madoff. Its an opportunity for me to inform the person what a true Madoff looks like. Besides, as a successful business man, one only has to look at the business Ive built in Harrison for the last twenty-seven years. You could talk to any number of clients where our time tested conservative financial solutions have assisted in enhancing their retirement as well as passing their wealth to their heirs. You could talk to families where we protected their assets from inflation and from Uncle Sam. Feel free to check me out based on all the ways I have described above.
