9.OnoraboutJune13,2009,Plaintiff,
TYLERHAYESWEINMAN,
wasarrestedbytheMiami-DadePoliceDepartmentandchargedwithnineteen(19)countsofanimalcruelty/harm/kill;four(4)countsofburglaryofadwelling,andnineteen(19)countsofdisposalofdeadanimals.10.OnJuly31,2009,theStateofFloridafileditsforty-two(42)countInformationthereinchargingPlaintiff,

withmultiplecountsofcrueltytoanimalsinviolationofFloridaStatutes,§828.12(2),athirddegreefelony;multiplecountsofburglaryofanunoccuRieddwellinginviolationofFloridaStatutes,_§810.02(3)(B),aseconddegreefelony,andmultiplecountsofanimal/disposalofdeadcarcassinviolationofFloridaStatutes,§823.041,aseconddegreemisdemeanor.11.TheprosecutionwasbaseduponaninvestigationconductedbytheMiami-DadePoliceDepartmentandtheMiami-DadeAnimalServicesDepartment.12.BeginninginAprilandintoearlyMayof2009,anumberofcatswerefounddeceasedintheCutlerBayareaofMiami-DadeCounty,Florida.ByMay13,2009,theCutlerBayPoliceDepartmentwasreceivingnumeroustelephonecallsregardingdeadcats.Thisinfluxofcallscompelledthepolicetocommenceaninvestigationintothekillingofthecats.Duetothecomplexityoftheinvestigation.aswellasotherconsiderations,theCutlerBayPoliceDepartmentcalledintheassistanceoftheMiami-DadePoliceDepartment.
