ThesubpoenacomplieswithneithertheNewYork,northeCalifornia,statutoryrequirementsforcreatingorservinganinterstatesubpoenaducestecum.NewYorklawincorporatestherequirementsofcivillawgoverningtheserviceofasubpoenaducestecum.NewYorkCriminalProcedureLaw§610.40("mustbemadeinthemannerprovidedbythecivilpracticelawandrulesfortheserviceofsubpoenasincivilcases.")ThecivillawofCaliforniathereforegovernsthisinterstatesubpoena,andthatlawrequiresanumberofnoticeandaffidavitrequirements,intendedtoprotectthedefendantJEFFREYRAE,allofwhichDistrictAttorneyCYRUSVANCEhasignored.CaliforniaInterstateandInternationalDepositionsandDiscoveryAct,CCP2029.100-CCP2029.900,andCaliforniaCodeofCivilProcedureSection1985.B.NewYorklawprotectsthedefendantadditionallybyrequiringthattherecordsandinformationsoughtberelevanttothetrialofthedefendant.NewYorkCPLR§3101(a)(materialsoughtmustbematerialandnecessary).

This fight is so important. The outcome of this can literally set precedence for the ability of courts across the country to use the subpoena as a fear and intimidation tactic to sensor free speech and right to collectively speak out against any establishments of power in the US . Stay strong Jeff!
