Anyanalysisofcriminalliabilityforspecificconductmustbeginwiththeanalysisofthecodesectionscriminalizingthatconduct.SpecificallyastoHealthandSafetyCode'sections11359and11360-

II.CALIFORNIA'SMEDICALMARIJUANASTATUTES
In1996,CaliforniavoterspassedtheCUA,ascodifiedinsection11362.5.Section11362.5,subdivision(d),provides
limited
affirmativedefensestomarijuanapatientsandtheirprimarycaregiversforpersonalpossession,
individual
cultivation,andmedicallyrelatedtransportation.(See,Peoplev.Mower(2002)28Ca1.4th457;Peoplev.Trippet(1997)56Cal.App.4th1532.)Thevoter'sintentinpassingtheCUAhasbeenestablishedbycaselaw. [B]oththestatute'sdraftersandtheproponentstookpainstoemphasizethat,exceptasspecificallyprovidedintheproposedstatute,neitherrelaxationmuchlesseviscerationofthestate'smarijuanalawswasenvisioned...[I]ntheballotpamphlet'srebuttal,[DistrictAttorneyHallinan,aCUAproponent,stated]thattheproposition"onlyallowsmarijuanatobegrown
