I.MARIJUANASALESAREILLEGAL
Anyanalysisofcriminalliabilityforspecificconductmustbeginwiththeanalysisofthecodesectionscriminalizingthatconduct.SpecificallyastoHealthandSafetyCode'sections11359and11360-

11359makespossessionforsaleofmarijuanaafelony:Everypersonwhopossessesforsaleanymarijuana,exceptasotherwiseprovidedbylaw,shallbepunishedbyimprisonmentinthestateprison.

II.CALIFORNIA'SMEDICALMARIJUANASTATUTES
In1996,CaliforniavoterspassedtheCUA,ascodifiedinsection11362.5.Section11362.5,subdivision(d),provides

affirmativedefensestomarijuanapatientsandtheirprimarycaregiversforpersonalpossession,
individual
