THECOURT:TheNunavutCourtofJusticemustoftenconductproceedingswithoutanadequatelevelofsecurityinsidethecourtroom.Thisisunacceptable.Noothercourtinthecountryisrequiredtositwithoutanadequatelevelofprotectionforjusticesystemparticipants,courtpersonnel,andjudiciary.Governmenthasaconstitutionalobligationtoensurethatthiscourt,Nunavut'sonlytrialcourt,isadequatelyresourced.Nootherneedismorebasicthantheneedforavisiblesecuritypresencetoaddressrealorpotentialthreatstopublicorderandpersonalsecurity.Thecourtroom,ofcourse,isoftenadifficultandavolatileenvironment.Thisisparticularlytrueinproceedingsinvolvinghomicideswherethefamilyofthedeceasedcanbeexpectedtoattend.Theabsenceofanyrealprotectioninsidethecourtroomexposesalljusticesystemparticipantsandcourtpersonneltoanobviousandveryrealoccupationalhazard.IamadvisedthattheRCMParenotabletoprovideforasecuritypresenceatthisproceeding.Theyareundernolegalobligationtodoso.SheriffServiceslackstheequipmentandthetrainingnecessarytoprovideadequatein-courtsecurity.
