On the second day of arguments before the Supreme Court about the health care reform law, the justices tackled the central question of whether the mandate to purchase insurance is constitutional. Court watchers suggested that the nine justices appeared to be closely divided among ideological lines with the most skeptical questions coming from the conservative justices. But both sides were trying to divine whether Justice Anthony Kennedy's questions indicated his own thoughts about the constitutionality of mandate.

Insurance has become thepredominant means of paying for health care in thiscountry. Insurance has become the predominant means ofpaying for health care in this country.For most Americans, for more than 80 percentof Americans, the insurance system does provideeffective access. Excuse me. But for more than 40million Americans who do not have access to healthinsurance either through their employer or throughgovernment programs such as Medicare or Medicaid, thesystem does not work. Those individuals must resort tothe individual market, and that market does not provideaffordable health insurance.3
