gradestudentbroughtaweapontoschoolandwhilestillonschoolpremises,shotathirdgradestudentinthearm.Accordingtothestudent'sfathertheweaponusedwasaBBgun.Thefather'sandthecomplaintsofothersappeartohavebeenflagrantlyignored.Therehasbeennoactionatall.SchoolpoliciesandgovernmentguidancesaysthatMs.McKoy'sdecisioninsuchaninstancedidnot

gradestudentwhothedaybeforehadcommittedtheoffenseofaggravatedassaultontoanotherstudent-whilebaskinginafalsesenseofimpunityresultingfromMs.McKoy'sapathyandunresponsivenesstohispriorviolationofthedistrict'spoliciesandstate'slaws-unperturbedlyreturnedtoschoolwiththesameweaponstashedinhisbackpack.Allegedly,theweaponwasdiscoveredbutMs.McKoytooknoactionatall.

4.Allegedly,thesamestudentwhohadbeeninpossessionofaprohibitedweaponfortwoconsecutivedayswithoutMs.McKoyadjudicatingapenaltyasperthedistrict'sownStudentCodeofConduct,wasalsofoundonlydayslaterinpossessionofacontrolledsubstancewhichhefreelydistributedtootherschoolchildren.Theinformationsofarunderstoodisthatonestudentingestedtheprescriptiondrugunlawfullydispensedtohimlher.Allegedly,noprotocolwasfollowedthistime,too.Contrarytodistrictpolicyandstatelaw,thestudentwassupposedlysuspendedforjusthalf-a-day.

theclassroomorschool.5.InoraroundlateJanuary,2012,afourthgradestudentintentionally,knowinglyandrecklesslyactivatedthefirealarm,causingthedispatchingofthefiredepartment.Theschoolalsohadtobeevacuated.Again,intotaldisregardfordistrictpolicyandstatelaw,Ms.McKoyallegedlychosetomerelysuspendthestudentforhalf-a-day.SchoolpoliciesandgovernmentguidancesaysthatMs.McKoy'sdecisioninsuchaninstancedidnotfallwithinthediscretionaryfunction.Thus,itlooksasifMs.McKoy'sactionswerenotcarriedoutinconformitywithfederal,state,and/or-local/districtlawsorpolicies

furtheranceofeffortstocontrol,discipline,expelorsuspendstudentormaintainorderorcontrolintheclassroomorschool.6.ThejobtitlesAdministratorandAcademicCoordinatorarenotoneandthesame.Eachjobtitleentailsdifferentdutiesandresponsibilitiesaswellaslegalmandates.

wouldappearthattheAcademicCoordinatorpositioninFelixG.BotelloElementarySchoolis

subsidizewithTitleIfundsandassuchonewouldreasonablyexpectthatthefulfillmentofthedutiesandresponsibilitiesofthejobareatalltimesinalignmentwiththelegalspecificationsoftheposition.
It
haslongbeensuspectedthatmanyofthedutiesproperofanadministratorareroutinelybeingperformedbyMs.AstraSmith,includingoverseeingalloftheteachers'disciplinaryreferrals.Tothisend,itappearsMs.McKoyhasillegallydelegatedthisresponsibilitytoMs.Smith,whoregularlyconductstheinvestigations.ThemainjobofanAcademicCoordinatoristohelpintheclassroom.Incongruously,eventhoughinvestigationsseemtoberegularlyperformedbyMs.Smith,itisnothersignaturetheoneappearingatthebottomofthereferralforms.Ms.Smith'sjobtitle,however,isthatofanAcademicCoordinator,notthatofanadministrator.Thus,thisconcernexploresthelegalandethicalissuesassociatedwiththeplausibleimproperdelegationbyMs.McKoyofadministrativeduties.Whatismore,Ms.SmithalsohasthedistinctionofbeingtheCILTmemberoftheschool'smathdepartment.Traditionally,aCILTmemberhasbeenaninstructionalmemberofourfaculty,notanAcademicCoordinatornora
