thisafternoonandafteryouprovidedtheschematicsandotherdocuments,aCityinspectordiscoveredanadditional,unidentifiedpipeattheColumbiaPackingfacility.ThishiddenpipewasreadilyiDeatedbytheCityinspectorbecauseithadanaccesspointcoveredbyalargemetalsheetinthemiddleoflarge,mowedfield.ThehiddenpipedoesnotappearonanyofthedocumentsColumbiaPackinghaspreviouslyprovidedtotheCity,butappearstoextendtowardstheColumbia

facilityinonedirection,andtowardsCedarCreekintheotherdirection.AColumbiaPackingworkerdugthehiddenpipeoutbyhand,andCitypersonnelviewedit.WhenIaskedwhetheryouOrColumbiaPackinghadknowledgeofthehiddenpipe,nobodyclaimedtohaveanyknowledge,Moreover,althoughyouandothersfromColumbiaPackingclaimeditwas"coHapsed,"
the
attachedphotosshowthatitwasclearlynot"collapsed"inatleastonedirection.Inaveryshortturnaroundofanhourorso,CityinspectorsreturnedtotheColumbiaPackingfacilitytoinspectandvideotapethispipeviaclosed-circuittelevision("CCTV").Atthistime,theCityhasnotmadetheconclusionthat"thereisnopotentialfordischargeorcrossconnection,"Indeed,asColumbiaPackingwellknows,apipethatisobstructedbymaterialscanresultinillicitdischargesiftheproperprecautionsarenottaken.GiventhecircumstancesandfactssurroundingColumbiaPacking'sviolations,theCitytakesthepresenceofunauthorizedpipesattheColumbiaPackingfacilityveryseriously.Moreover,thefactthatCityinspectorsarediscoveringadditionalpipingatthefacilityatthislatedatecastsseriousdoubtonwhetherColumbiaPackinghasbeendiligentin

Forthesereasons,amongothers,itwouldbeinappropriatefortheCitytogivethedocumentsprovidedthisafternoonanythingotherthananattentiveandcarefulreview.Whendocumentsarereceivedwithonlyafewbusinesshoursleftintheday,itisunreasonabletoexpectthattheycanbeproperlyreviewedandconsideredonasame-daybasis.TheCityagreesthatthepipeshouldberemoved,butanyremovalshouldtakeplacewithaCityinspectoron-site,Becauseoftheheavyrainsexpectedthisweekend,itdoesnotseemadvisabletoremove
