Dear Mr. Charles: This letter is in response to your March 26,2012 Public Records Act request for the police log and police radio traffic related to the shooting ofKendrec Lavelle McDade as well as for any 9-1-1 calls regarding this incident. The 9-1-1 tape was provided to you yesterday at the press conference. Certain contact information was redacted from the 9-1-1 tape to protect the privacy interests of the individuals involved under Government Code Section 6254( c) and Article I, Section I of the California Constitution. The police log and radio traffic are exempt from disclosure under the Public Records Act and are not required to be released. The Government Code Section 6254(f) allows for certain information about citizens' complaints and requests for assistance to be disclosed to the public. The Call for Service Log which contains information that can be provided and which will not jeopardize the investigation of this incident is attached. It contains the information culled from the radio transmissions you requested and can be released under the Government Code. Release of information from public agencies is governed by the Public Records Act set forth in Government Code Section 6250 et. seq. Although there is a presumption that all records are public, records related to complaints to and

investigations by local police agencies have been made specifically exempt from disclosure under Government Code Section 6254(1). Case law has held that the actual recordings of police transmissions are not public records and do not need to be disclosed in response to a Public Records Act request. As discussed in Havnie v. Superior Court (2006) 26 Ca1.4th1061, the City is not required to produce the actual recordings, only the information required to be provided under Government Code Section 6254(1). The public policy behind this exemption is to protect not only the investigative process but it also recognizes the vast amount of personal and official information that might be contained in such tapes and would have to be redacted. Consequently, none of the actual tapes of the radio transmissions from which this information is derived will be provided. Thank you for your understanding in this matter.
