NO._COUNTYOFPIERCECOMESNOWDetectiveGarySanders,PierceCountySheriffsDepartment,beingfirstdulysworn,underoath,deposesandsays:That,onoraboutthe25thdayofAugust,2011inPierceCounty,Washington,felonies,to-wit:PossessionofChildPornography,aviolationofR.C.W.9.68A.070andVoyeurism,aviolationofR.C.W.9A.44.115werecommittedbytheact,procurementoromissionofanother,thatthefollowingevidence,to-wit:1.Photographs,motionpicturefilm,videotapes,digitalimages,oranyotherrecordingortransmissionsoftheimageofapersonthatwererecordedwithoutthatperson'sknowledgeandconsentwhilethepersonbeingviewed,photographed,orfilmedwasinaplacewhereheorshewouldhaveareasonableexpectationofprivacy.2.Photographs,motionpicturefilm,videotapes,digitalimages,oranyotherrecordingortransmissionsoftheimageofaperson'sintimateareasthatweretakenwithoutthatperson'sknowledgeorconsentandundercircumstanceswherethepersonhasareasonableexpectationofprivacy,whetherinapublicorprivateplace.3.Photographs,motionpicturefilm,videotapes,digitalimagesoranyotherrecordingortransmissionsoftheimagesdepictingminorsengagedinsexuallyexplicitconduct.ismaterialtotheinvestigationorprosecutionoftheabovedescribedfelonyforthefollowingreasons:1.Photographs,motionpicturefilm,videotapes,digitalimages,oranyotherrecordingsortransmissionsoftheimageofapersonthatwererecordedbyStevenPowellwithouttheirknowledgeorconsentwheretheywouldhaveareasonableexpectationofprivacywouldhelpdeveloptheelementsofthecrimeofvoyeunsm.2.Photographs,motionpicturefilm,videotapes,digitalimages,oranyotherrecordingsortransmissionsoftheimageofaperson'sintimateareasthatwererecordedbyStevenPowellwithoutthatperson'sknowledgeorconsentandunder

AvenueCourtEastinPuyallup.ThisresidencebelongstoStevenPowellandhisson,JoshuaPowellalsoresidesthere.TheSearchWarrantwasregardingtheinvestigationofthemissingwifeofJoshuaPowell,SusanPowell.
It
wasdiscoveredthroughtheinvestigationthatStevePowellhadaverystrongobsessionforhisdaughter-in-law,SusanPowell.InadditiontohisownwordstolawenforcementandthemediaonhowhedesiredSusanPowell,officerslocatedinStevePowell'sbedroomand/orclosetseveralimagesofSusanPowellthatweretakensecretly.Insomeimages,SusanPowellwasfullyclothedwhileinotherimagesshewasonlyinherunderwear.DetectiveMaxwelldescribedoneimageofSusanPowellinabathroomdoingherhairwhiledressedonlyinherunderwear.Basedoffofthephotograph,itappearedthephotographerwastakingthispicturesecretlythroughtheslightlyopeneddoorwithoutSusanPowellknowing.AnotherimagewasofSusanPowellwhileshewassittingatatablewearingadress.Basedontheimage,thephotographerphotographedSusanPowellsecretlywhileshewaslookingawayfromthecamera.Theimageshow's
 
SusanPowell'slegsslightlyopen,exposingherunderwear.SeveralVHSand8mmcassettesthatwereblankand/orhadSusanPowell'snamewrittenonthemwereseized.TheevidenceseizedfromthePowell'sresidenceonAugust25,2011wasreleasedtotheWestValleyCityPolice,Utahforfurtherreview/examinationwitharequestfromthePierceCountySheriffsDepartmentthatiffurtherevidenceofvoyeurismwaslocatedthattheyprovidethatevidencetothePierceCountySheriffsDepartmentforfurtherinvestigationandprosecution.WestValleyCityPolice,UtahobtainedanapprovedThirdDistrictSearchWarranttoreviewalltheVHScassettes,8mmvideocassettes,compactdiscsand/orDVD'stolocate/identifyadditionalvictims/evidenceofvoyeurismbasedoffofinformationandimageslocatedduringthecourseofthesearchwarrantandduringtheevidencereviewwhilelookingfordigitalcopiesofSusanPowell'sjournals.DetectiveMaxwelltoldyouraffiantduringthecourseofreviewingcompactdiscsthatwerelocatedinStevePowell'sbedroomand/orcloset.Adisccontainedwhatappearstobechildpornography.DetectiveMaxwelltoldyourAffiantthereareapproximately50plusimagesthatappeartobechildpornography.Basedoffofhistrainingandexperience,DetectiveMaxwelltoldyourAffiantthathebelievesthetwofemalegirlsappeartobeprepubescentagingbetweenseventotwelveyearsofage.Theimagesappearthatthephotographerwasrapidlytakingpicturesortheimageswerecreatedasaphotofilefromavideorecording.
In
therecordingandimages,onechildisinthebathtubcompletelynudefollowedbyseveralimagesshowingherstandingupinthebathtubwashinghervaginaandexposingherundevelopedchest.
In
someoftheimages,asecondfemalechildentersthebathroom.Thisfemaleappearstobeolder,appearingtobeabouttwelveyearsofage.Anotherdisccontainedseveralimagesofentirefamiliesthatwerecompletelynudeincludingchildren.Theimagesareofthefamilywalkingandposingonbeacheswhiletheyarenude.Youraffiantadvisesthecourtsthatnotallofthepornographicimageswereexaminedtodeterminewhetherornottheywerechildpornography.Theaffiantbelievesthattheabovelisteditemsofevidencemaybeconcealedand/orlocatedonthepremisedescribedasthelocationoftheintendedsearch.
