IamalsowritingtorequestclarificationontheUS.DepartmentofHealthandHumanServices'(HHS)positionrelatedtolong-standingprohibitionsontheuseoftaxpayerdollarstolobbygovernmententities,whichyouhavediscussedseveraltimesinrecentweeksduringCongressionalhearings.Lastyear,PresidentObamasignedintolawtheFY2012appropriationsbill(omnibus).Section503oftheomnibusstatesthat"anyactivitytoadvocateorpromoteanyproposed,pendingorfutureFederal,Stateorlocaltaxincrease,oranyproposed,pending,orfuturerequirementorrestrictiononanylegalconsumerproduct,includingitssaleormarketing,includingbutnotlimitedtotheadvocacyorpromotionofguncontrol,"isnotallowedbygroupsbenefittingfromgrantmoniesawardedthroughtheAffordableCareAct'sPreventionandPublicHealthFund.

WhilethePresident'smostrecentbudgetsubmissioneliminatesthisanti-lobbyingprovision,theexistinglawisquiteclear.Furthermore,theseprovisionshavelongbeeninexistence.Asearlyas1919,18U.S.C.Section1913wassignedintolaw.Knownasthe"Anti-LobbyingAct,"18U.S.c.1913states:NopartofthemoneyappropriatedbyanyenactmentofCongressshall,intheabsenceofexpressauthorizationbyCongress,beuseddirectlyorindirectlytopayforanypersonalservice,advertisement,telegram,
