Pursuant to Fed. R. App. P. 26(B), Appellants Trustees of Boston Collegeand two of its representatives, Robert K. O’Neill, the Librarian of the John J. BurnsLibrary at Boston College, and Boston College University Professor Thomas E.Hachey (collectively, “Boston College”), move for a ten-day enlargement of timeto file their opening brief and appendix, and cite as reasons therefor the following:1. The opening brief and appendix of Boston College as appellant arepresently scheduled to be filed by April 23, 2012.

2. In-house counsel for Boston College reviewing and contributing to thebrief has a previously long-scheduled vacation commitment out of the Boston areafrom April 13 to April 22, 2012.3. The issues involved in this appeal are complex, and involveaddressing issues in a public as well as a sealed record, which require additionaltime to present Boston College’s arguments to this court in a succinct manner.4. Boston College has not sought or been granted any previousenlargement of time for its opening brief and appendix.5. The Government has authorized Boston College to advise the Courtthat the Government assents to this motion, and does so with the hope that briefingin this case will proceed expeditiously and that the case will be ready for argumentby this Court’s September sittingFor the reasons stated in this motion, Boston College moves that this Courtenlarge the time by which to file its opening brief as appellant and appendix by tendays, from April 23 to May 3, 2012.By their attorney, /s/ Jeffrey SwopeJeffrey Swope (BBO# 490760)E
