12.OnoraboutMay27,2010,StandardandAmherstenteredintoacontract(the"Contract")fortheconstructionoftheProjectforalump-sumpriceof$11,072,705.13.Almostimmediatelyafteritcommencedwork,StandarddiscoveredthattheContractDocumentswereincomplete,defectiveanddeficientandthat,despiteAmherst'srepresentationstothecontrary,neithertheContractDocumentsnorAmherst'sbuildingprogramwerecompleteatthetimeofthesolicitationforbids.14.

fact,overthecourseoftheProject(whichisnearingfinalcompletion)Standardwasforcedtosubmitapproximately700RequestsforInformation("RFIs")seekingclarificationandinformationontheincomplete,defectiveanddeficientContractDocuments.15.TheRFIsdevelopedintonearly630ChangeOrderRequests("CORs")whichnecessitatedanadditional$3.3MillionworthofworknotoriginallycontemplatedatthetimeoftheexecutionoftheContract.AtonepointStandardwasissuingapproximately75RFIspermonth.16.AsaresultofAmherst'sundefinedprogramandtheincomplete,defectiveanddeficientContractDocuments,StandardwasrequiredtooperateinamannerthatnegatedStandard'soriginalworksequenceplanandrequiredStandardtocontinuallyre-sequencetheworkontheProject.17.Asconstructionwasongoing,StandardwasalsoforcedtocontinuallyperformconstructabilityreviewoftheContractDocumentsandassistAmherstwithsolutionstovariousincompleteanddefectivedesignelementsontheProject.18.Moreover,AmherstanditsdesignteamfailedandrefusedtorespondtoStandard'sRFIsandotherinformationrequestsinatimelymanner,therebyfurtherthwartingStandard'seffortstocompletetheProjectasoriginallyplannedandscheduled.
