IamtheregionalmanagerforthemanufacturedhousingcommunitiesownedandoperatedbyentitiesassociatedwithMorganManagement,LLC.2.ThismatterconcernsamanufacturedhousingcommunityknownastheSpruces,locatedinWilliamstown,Massachusetts(the"Spruces"of"Park")devastatedbytherecentTropicalStormIrene(hereinafter"TropicalStormIrene").3.Therewereapproximatelytwohundredtwenty-six(226)manufacturedhomesofwhich213wereoccupiedandlocatedwithintheSprucespriortotheTropicalStormIrenethatdevastatedMassachusettsonoraboutAugust,2011.4.OnoraboutAugust28,2011,TropicalStormIrenehittheCommonwealthofMassachusettsandcausedsubstantialdamageandfloodingwithintheSpruces.5.SprucessustainedfloodingandwasdeclaredanaturaldisasterbytheFederalEmergencyManagementAgency("FEMA").

6.AsdirectresultofTropicalStormIrene,theTownofWilliamstowndeclaredthatthemanufacturedhomeslocatedwithintheParkcouldnotbeoccupiedandorderedtheSprucestobeevacuated,alongwithgasandpowertothehomestobeshutoff.

AsofSeptember6,2011,theTownofWilliamstowncondemnedfifty-six(56)homeslocatedwithinthePark,declaringthattheywerenotfitforhumanhabitation.8.AsofSeptember30,2011,theTownofWilliamstownhascondemnedonehundredforty-six(146)unitslocatedwithinthePark,declaringthemunfitforhumanhabitation.Presently,thereareonehundredandtwenty-fourcondemned(124)homes.9.Currentlythereareforty-six(46)homesintheSpruceswhicharefitforhumanhabitationandoccupied.10.
It
isunclearhowmanyadditionalmanufacturedhomeswillbeabletobeoccupied.11.InorderfortheSprucestooperatefunctionallyandfinancially,eighty(80%)percentofthetwohundredtwenty-six(226)homesitesneedtobeoccupiedandpayingrentinorderfortheParktosustainitself.12.Plaintiffisnotcollectingrentfromanytenantsastheyaresimplynotpaying.13.TropicalStormIreneandthedestructionitcausedintheSprucesisoccasionedexclusivelyasanactofnatureandisthesolereasonandcausefortheSprucesbeingunabletofunctionandoperate.14.AsaresultofTropicalStormIrene,thePlaintiffisnotablefinanciallytoprovideservicestotheSprucesasamanufacturedhousingcommunitylikentothoseprovidedbeforethetropicalstormgiventhereductioninsizeandanticipatedcorrespondingreductioninrents.15.TropicalStormIreneisthesoleandproximatelycauseofthePlaintiff'sinjuryandthemagnitudeoftheeventscausedbythetropicalstormwerenotforeseeableandnohumanconductcontributedtotheoccurrenceofthisinjury.

16.ThePlaintiffhasbeennotifiedbyvariousentitiesdemandingthatPlaintiffmaintainitsobligationsasamanufacturedhousingcommunitydespitetheconsequencesofTropicalStormIrene.17.Recently,theHousingCourtsittinginPittsfieldheardcomplaintsforinjunctiverelieffromcertainresidentsrequestingthattheirelectricitybere-instatedtotheirmanufacturedhomes.18.AttachedtothememorandumisamapoftheParkdenotingthosehomesthathavebeencondemnedandthestatusoftheothers,particularlyrelatingtowhetherelectricityisavailable.19.TheCourtissuedrulingsorderingthatelectricityberestoredtothepartiesintheactionsandPlaintiffsarecomplyingandallelectricalthatwecandohasbeencompleted20.
It
isuncertainthatallofthesehomescaneverbereoccupied.OnlyLindaBellandLindaChesbrohavebeenclearedtoreoccupytheirhomes.21.Presently,thereareordersfromtheHousingCourttorestoreelectricitytothehomesofLindaBellat125RiversideDrive,LauraBrodeurat85BachandAvenue,LindaChesbroat8HigginsCourt,DonnaBishopat96EmeraldLane,JamesDolanat102RiversideDriveandRaymondCoxat79BachandAvenue.Weareintheprocessofcomplyingwiththeorders.ManyoftheseindividualswentintoCourtbeforenotifyingorattemptingtoworkwithus22.Wehavebeenattemptingtoascertain,whatresidentsoftheeighty-sevenwhoseelectricitywasimpactedbyTropicalStormwillbereturningtothePark.Wehavetoinstallanewelectricalsystem.WithoutknowingwhoisreturningitisdifficultifnotimpossibletocreateanewelectricalsystemfortheParkgoingforward.23.Moreover,ifadditionalindividualsreturnafterweinstalledelectricalpowertohomesaroundhomessuchastheabovereferencedindividuals,wewillhavetoundoandredotheelectricalworksinceanewhomeisbeingaddedatgreatexpense.24.Sofar,Spruceshasspent$30,831.23onrestoringpowertothesehomes.
