II.FactsoftheInstant
Case
TheDefendantand

hadknowneachotherforapproximatelythreeyearsandweremarriedonMay14,2010.TheDefendanttestified
that
hadbatteredherinthepast,includinginSeptemberof2009causinginjuriestoherheadandback.Thereafter,sheobtainedaninjunctionforprotectionwhichwasineffectonthedateatissue.(hasapriorconvictionfordomesticbattery.)OnAugust1,2010,theDefendantshotatornearand~.TheDefendanthadnotbeenlivinginthemaritalhomeforthetwomonthsleadinguptotheshooting.OntheeveningofJuly31,2010,theDefendantdroveherselftothemaritalhomeandparkedinthegarage,closingthegaragedoorafterparkinghervehicle.TheDefendantstayedthenightinthemaritalhome.Thenextmorning,onAugust

2010,arrivedatthemaritalhomewithhis
