PRELIMINARY STATEMENT
The Government respectfully submits this memorandum inconnection with the April 26, 2012 sentencings of two of the sixdefendants who now stand convicted of bribery crimes in thiscase: (1) Carl Kruger, a titan of the New York State Senate andchair of its Finance Committee, who, over a period of years,systematically and wantonly betrayed the public trust bysoliciting hundreds of thousands of dollars of bribes; and (2)Michael Turano, a physician and member of Carl Kruger’s adoptedfamily, who was one of the primary financial beneficiaries ofKruger’s bribery schemes.Together with the four bribe-payors now convicted in thiscase -- lobbyist Richard Lipsky, hospital executives David Rosenand Robert Aquino, and health care consultant Solomon Kalish --Kruger and Turano worked to undermine the core and abidingprinciple of democratic governance, that elected representativeswill act solely in the interest of the public good. Instead,Senator Kruger, for the benefit of the Turano family, enteredinto serial corrupt bargains and in so doing violated the sacredduty vested in him to provide honest services to the people ofthe State of New York.For the reasons set forth below, and in light of the factorsset forth in Title 18, United States Code, Section 3553(a), theGovernment respectfully requests that the Court sentence Kruger1
 
to a period of imprisonment within the recommended Guidelinesrange of 108-135 months, and that the Court sentence Turano to asubstantial term of imprisonment, but one below the stipulatedGuidelines range of 60 months.
BACKGROUND
Carl Kruger was one of the most influential power-brokers inAlbany. Initially elected in 1994, Kruger quickly establishedhimself as a force to be reckoned with in Albany. He assumed asuccession of powerful positions in the New York State Senate,ultimately rising to become chair of the Senate Finance Committeefrom 2009-2011, where he exercised great influence over thebudget for New York State.While Kruger certainly leveraged his power to do many gooddeeds for the constituents of his district as well as for thecitizens of New York State as a whole, Kruger also corruptlytraded his power and influence for money over a period of years.Kruger now stands convicted of engaging in two separate butsubstantial bribery conspiracies, one involving the prominentlobbyist Richard Lipsky, and one involving various individualsseeking Kruger’s assistance in the health care industry.The bribery schemes worked as follows: The bribe-payors paidmoney, directly or indirectly, to one of two consulting companiescontrolled by Michael Turano, namely, Olympian Strategic2
