Interagency
WorkingGroup,and
we
stronglyurgeyoutoconsiderwithdrawingtheguidelines..
.Thelatest
guidelines,released
in
April
ofthisyear,represent
an
alarmingregulatory
overreach
on
the
part
ofmembers
of
the
Interagency
Working
Group,Asyou
know,
theFY2009OmnibusAppropriationsActdirectedtheUSDA,FDA,CDC,andFTCtocompleteastudyandtoproviderecommendations
in
theformofareport
to
Congress.
Forreasons
that
remain
unclear,
the
InteragencyWorkingGroup
failed
tocompletethestudyor
delivera
report,
but
insteadwentaheadwithproposingwide-rangingindustrymarketingguidelines.Whiletheprinciplesput
forth
by
theInteragencyWorkingGroupare
"voluntary,"
theyarestillcauseforconcernastheyappear
to
beanattempttoregulateabsentCongressionalaction.
If
Congress
wished
to
regulatethemarketing
offood
andbeverageproductstochildren
and
teens,
they
woulddoso.NotwithstandinganyactionfromCongress,andattime
of
budgetconstraintsand
competing
agencypriorities,
it
is
troubling
tolearnthatvaluableagencyresourceshavebeendivertedtoseekobjectivesfarbeyondthe
intentof
Congress.Moreimportantly,weareconcernedwiththecontentoftheproposedguidelinesputforthbytheInteragencyWorking
Group.
UndertheproposedNutritionPrinciples,
many
healthyfoodscouldnolonger
be
marketedto
kids
andteens,includingtwopercent
milk,
mostsoups,manycereals,manybreads,andmostcheese.Furthermore,theInteragencyWorkingGroup
proposal
isclearlyinconsistentwithotherfederal
nutrition
standards.Manyofthese
foodshave
longbeenconsideredhealthyandincluded
in
the
WIe
program.Evenmarketingforapeanutbutterandjellysandwichwouldbebannedundertheproposal.Yet,
school
cafeteriasservepeanutbutterandjellysandwicheseverydaythroughourNationalSchoolLunchProgram.Whilewerecognizetheneedto
address
thegrowingtrendofchildhoodobesity,
it
isirresponsibleto
put
forthasetofindustryguidelinesthatignoresinherentcontradictions
in
federalpolicy.
