Statement of Prosper Police regarding events of 4/23/12

PROSPER (April 24, 2012) Officers of the Prosper Police Department responded to a call from a residence at 1200 North Preston Road in Prosper at approximately 4:30 p.m. on Monday, April 23, 2012 for a domestic disturbance. Upon arrival, the responding officers received a complaint from Mr. Deion Sanders, 44, a resident of the address, regarding an alleged assault carried out by Mrs. Pilar Sanders, 38, also a resident of the address. The complaint also alleged that a second perpetrator was involved in the alleged assault, Ms. Dianna Boswell, 38, a resident of McKinney. Following a preliminary investigation at the scene, responding officers deemed it prudent to detain Mrs. Sanders, and placed her in custody, remanding her to the Collin County Detention Facility in McKinney, charged with a Class C Simple Assault, a misdemeanor. Further investigation of the circumstances prompted the responding officers to cite Mr. Deion Sanders and Ms. Dianna Boswell with Class C Simple Assault. The misdemeanor charge does not generally rise to the level of detention, however, the on-scene investigating officers, based on their experience, judgment and understanding of the immediate situation, made the decision to remand Mrs. Sanders to the Detention Facility. The investigation into this incident is continuing. There has been a contention that Mrs. Sanders requested a protective order from the Prosper Police Department some time prior to this incident. Mrs. Sanders did visit the Police Dept., and her conversation with the responding officer is confidential. However, in an effort to clarify the issue, a protective order is granted by a Court of Law and the application for an order must be from the victim or the prosecuting attorney acting on behalf of the victim. The police department does not issue a protective order. The Police Dept.s practice is to direct the individual to the prosecuting attorney for assistance in making the application to the Court that has jurisdiction. In emergency situations where there has been an arrest, an application for an emergency protective order can be completed, but is only good temporarily in order to give the victim time to seek a regular protective order.
