listofbutcher,receiver,brunchprepattheRestaurant,inadditiontooff-siteerrandduties.4.Duringthefirstthreeweeksofhisemployment,PlaintiffKimdidnotreceiveanywagesfromDefendants.5.ThroughouthisemploymentwithDefendants,PlaintiffKimneverreceivedproperovertimeorspread-of-hourwages.6.Inaddition,DefendantsMoonandParkwillfullymisrepresentedtoPlaintiffKimthathewasemployedasan"apprentice"intheculinaryarts,andalternatelyanderraticallypaidhimstraight"salary"wagesandhourlywages.Atnotime,however,didPlaintiffKimreceiveproperpaymentforthehoursworked.7.AccordingtotheU.S.DepartmentofLaborandNewYorkStateDepartmentofLabor,noapprenticeshipprogramwasregisteredwiththeunderNYLACafe,LLCorSungPark'snameduringtherelevanttimeperiod.Evenifanapprenticeshiportrainingprograminfactexisted,theNewYorkStateDepartmentofLaborregulation,12N.Y.C.R.R.§146-2.11,requiresthatapprenticesmustbepaidatleasttheminimumratesprescribedintherelevantindustrywageorder.8.Plaintiffseekstorecoverhislawfulminimumwages,overtimewages,spread-of-hourswages,plusliquidateddamages,prejudgmentinterest,compensatorydamages,andattorney'sfeesandcosts.JURISDICTION

10.VenueisproperintheSouthernDistrictofNewYorkpursuantto28U.S.C.§1391(b)and(c)inthatDefendantNYLACafe,LLCislocatedinthisDistrict,andtheunlawfulactionsoromissionscomplainedofoccurredin,andtherecordsrelevanttosuchpracticesaremaintainedin,thisDistrict.PLAINTIFF11.PlaintiffEdwardKimisanadultindividualcurrentlyresidinginQueens,NewYork.12.PlaintiffKimwasemployedbyDefendantsasaprepcook,butcher,andreceiveratSpitzer'sCornerfromapproximatelylateMarch2010untilJanuary6,2011.Typically,hisshiftsattheRestaurantlastedanywherefrom10to19hoursaday,sixdaysaweek.13.PlaintiffKimwasengagedincommerce.AllemployeesatSpitzer'sCornerareengagedinanindustryaffectingcommerce.14.Atalltimesrelevanttothisaction,PlaintiffKimwasDefendants'employeewithinthemeaningoftheFairLaborStandardsActandNewYorkLaborLaw.DEFENDANTS15.DefendantNYLACafe,LLCwasincorporatedintheStateofNewYorkandoperatesat101RivingtonStreet,NewYork,NewYork.Uponinformationandbelief,NYLACafe,LLCisownedbyDefendantRobertShamlian,andanunknownnumberofadditionalinvestors.16.CorporateDefendantNYLACafe,LLCisabusinessengagedininterstatecommerceoranenterpriseengagedininterstatecommercethathadgrosssalesexceeding$500,000peryear.Uponinformationandbelief,theRestaurantpurchasesandhandlesgoodsmovedininterstatecommerce.17.Uponinformationandbelief:DefendantShamlian,asownerandofficerofSpitzer's3
