confederated,andagreedtogetherwitheachotherandwithotherpersons,bothknownandunknowntotheGrandJury,totravelandtocauseanothertotravelininterstatecommerceandtouseandtocauseanothertouseafacilityofinterstatecommerce,withintentthatthemurderofanotherpersonbecommitted,inviolationofthelawsoftheStateofTexasandoftheUnitedStates,asconsiderationforthereceiptof,andasconsiderationforapromiseandagreementtopay,thingsofpecuniaryvalue,towit:$50,000cashandfivekilogramsofcocaine.3.OnoraboutJanuary2011,MARCUSMICKLE,begantonegotiatewithDrugEnforcementAdministration(DEA)undercoveragentsforthepurchaseofmarijuana.TheundercoveragentstoldMICKLEtheyworkedforlosZetascartel.MICKLEinitiallyproposedprovidingstolenfirearmsasadownpaymentforthemarijuana.Thesenegotiationscontinuedforseveralmonths.4.Asaresultofthesenegotiations,onoraboutSeptember14,2011,MICKLEandCALVINEPPStraveledtoLaredo,Texastomeetinpersontheundercoveragents,whotheybelievedworkedforlosZetas.Atthismeeting,MICKLEandEPPSproposedthattheundercoveragentsprovidethemwith500poundsofmarijuana.MICKLEandEPPSwouldthendistributethismarijuanaintheColumbia,SouthCarolinaarea.MICKLEandEPPSalsodiscussedthepossibilityoffuturedrugshipmentswiththeagentsandstatedthattheywouldpay$350perpoundfortheundercoveragentstodeliverthemarijuanatotheColumbia,SouthCarolinaarea.5.Duringthismeeting,onoraboutSeptember14,2011,MICKLEandEPPSalsostatedthattheywoulduseaportionoftheprofitsfromthesaleofthemarijuanatopurchaseweaponsfortheundercoveragents.Theycouldacquirehandguns,rifles,fully-automaticrifles,andgrenades.MICKLEandEPPSstatedthatanacquaintance,KEVINCORLEY,couldprovidemilitaryweapons.

iiiidercoveragentstoKEVINCORLEYduringaconferencecall.Aspartofthisconferencecall,KEVINCORLEYstatedhewasanactivedutyofficerintheU.S.Armyresponsiblefortrainingsoldiers.KEVINCORLEYofferedtoprovidetacticaltrainingformembersofthecartel.Specifically,heofferedtoteachapproaches,roomclearing,security,andconvoysecurity.KEVINCORLEYalsostatedthathecouldpurchaseweaponsforthecartelaslongashecoulddestroytheserialnumbers.7.FromonoraboutSeptember2011toonoraboutDecember2011,KEVINCORLEYremainedincontactwiththeundercoveragentsviatelephonecalls,textmessaging,andemails.KEVINCORLEYdiscussedstealingweaponsfrommilitaryposts,howtoremovesearpinstomakeriflesfirefaster,andothermilitarytactics.7.OnoraboutDecember2,2011,theundercoveragentsreceivedanArmyTacticsBattleBookwhichitisbelievedKEVINCORLEYmailed.8.Duringaconversation,onoraboutDecember23,2011,KEVINCORLEYofferedtoperform"wetwork."9.OnoraboutJanuary7,2012,KEVINCORLEYtraveledtoLaredo,Texastomeetwithundercoveragents.Duringthismeeting,KEVINCORLEYstatedthathecouldraidaranchlocatedatornearLaredo,Texascontaining20kilogramsofcocaineandconductacontractkillingthere.KEVINCORLEYproposeda$50,000feeforthisworkbutstatedhewouldneedtobringhisownteam.Afterfurthernegotiation,KEVINCORLEYstatedhewouldaccepta$50,000feeandfivekilogramsofcocaine.10.Duringthissamemeeting,onoraboutJanuary7,2012,KEVINCORLEYdiscussedMICKLEandEPPSplannedpurchaseof500poundsofmarijuana.KEVINCORLEYstatedhewouldprovidesecurityforthetransportofthemarijuanafromTexastoSouthCarolina.KEVIN
