The Philippine Supreme Court, voting 8-7, on Oct. 14 declared “contrary to law and the Constitu- tion” the Memorandum of Agreement on Ances- tral Domain (MOA-AD) signed in Kuala Lumpur by peace panel negotiators of the the Government of the Republic of the Philip- pines (GRP) and the Moro Islamic Liberation Front (MILF).

Grave abuse

“In sum, the Presiden- tial Adviser on the Peace Process committed grave abuse of discretion when he failed to carry out the per-

tinent consultation process, as mandated by Executive Order (EO) 3, Republic Act (RA) 7160, and RA 8371,” the High Court said.

“The furtive process by which the MOA-AD was de- signed and crafted runs con- trary to and in excess of the legal authority, and amounts to a whimsical, capricious, oppressive, arbitrary and despotic exercise thereof,” it said.
