ENDURINGSTRATEGICPARTNERSIDPAGREEMENTBETWEENTHEUNITEDSTATESOFAMERICAANDTHEISLAMICREPUBLICOFAFGHANISTANI.PREAMBLE
TheIslamicRepublicofAfghanistan("Afghanistan")andtheUnitedStatesofAmerica("UnitedStates")havepartneredcloselysince2001torespondtothreatstointernationalpeaceandsecurityandhelptheAfghanpeoplechartasecure,democratic,andprosperousfuture.Asaresult,Afghanistanisnowonapathtowardssustainableself-reliance
in
security,governance,economicandsocialdevelopment,andconstructivepartnershipattheregionallevel.ThePartiesexpresstheirappreciationfortheNovember2011TraditionalLoyaJirga,whichdeclared:"Emphasizingtheneedtopreservetheachievementsofthepasttenyears,respecttheAfghanConstitution,women'srights,freedomofspeech,andtakingintoconsiderationtheprevailingsituationintheregion,strategiccooperationwiththeUnitedStatesofAmerica,whichisastrategicallyofthepeopleandgovenunentofAfghanistan,isconsideredimportantinordertoensurepolitical,economicandmilitarysecurityofthecountry.SigningastrategiccooperationdocumentwiththeUnitedStatesconformswiththenationalinterestofAfghanistanandisofsignificantimportance...WhensigningthisdocumentAfghanistanandtheUnitedStatesmustbeconsideredastwosovereignandequalcountries",inaccordancewiththeCharteroftheUnitedNations.EmphasizingtheirshareddeterminationtofurtheradvancetheAfghanpeople'sdesireforastableandindependentAfghanstate,governedonthebasisofAfghanistan'sConstitutionandshareddemocraticvalues,includingrespectforthefundamentalrightsandfreedomsofallmenandwomen,AfghanistanandtheUnitedStates(''theParties")committostrengthenlong-termstrategiccooperationinareasofmutualinterest,including:advancingpeace,security,andreconciliation;strengtheningstateinstitutions;supportingAfghanistan'Slong-termeconomicandsocialdevelopment;andencouragingregionalcooperation.Recognizingthecontinuedrelevanceoftheircommitmentsatthe2010LondonandKabulConferences,aswellasthe2011BonnConference,thePartiesaffirmtheirresolvetostrengthenAfghanistan'sinstitutionsandgovernancecapacitytoadvancesuchareasoflong-termstrategiccooperation.CooperationbetweenAfghanistanandtheUnitedStatesisbasedonmutualrespectandsharedinterests-mostnotably.acommondesireforpeaceandtostrengthencollectiveeffortstoachievearegionthatiseconomicallyintegrated,andnolongerasafehavenforal-Qaedaanditsaffiliates.AfghanistanandtheUnitedStatesgoforwardinthispartnershipwithconfidencebecausetheyarecommittedtoseekingafutureofjustice,peace,security,andopportunityfortheAfghanpeople.Respectforthesovereigntyandequalityofstatesconstitutesthefoundationofthispartnership.
 
-2-Respectfortheruleoflaw,aswellasthesoundandtransparentadherencetoAfghanistan'sConstitutionandallotheroperativelaws,reinforcesitsfoundation.ThePartiesreaffirmtheirstrongcommitmenttothesovereignty,independence,territorialintegrityandnationalunityofAfghanistan.Accordingly,thePartiesagreetothefollowing:
II.PROTECTINGANDPROMOTINGSHAREDDEMOCRATICVALVES
I.ThePartiesagreethatastrongcommitmenttoprotectingandpromotingdemocraticvaluesandhumanrightsisafundamentalaspectoftheirlong-termpartnershipandcooperation.2.UnderscoringthecentralimportanceofthevaluesandprinciplesoftheAfghanConstitution,Afghanistanreaffirmsitsstrongcommitmenttoinclusiveandpluralisticdemocraticgovernance,includingfree,fair,andtransparentelectionsinwhichallthepeopleofAfghanistanparticipatefreelywithoutinternalorexternalinterference.Reaffirmingitscommitmentsmadeatthe2011BonnConference,Afghanistanshallstrengthenandimproveitselectoralprocess.3.AfghanistanreaffirmsitscommitmenttoprotectinghumanandpoliticalrightsunderitsConstitutionandinternationalobligations,includingtheInternationalCovenantonCivilandPoliticalRights.Inthisregard,Afghanistanshallstrengthentheintegrityandcapacityofitsdemocraticinstitutionsandprocesses,includingbytakingtangiblestepstofurthertheefficiencyandeffectivenessofitsthreebranchesofstate,withinitsunitarysystemofgovernment,andsupportingdevelopmentofavibrantcivilsociety,includingafreeandopenmedia.4.AfghanistanreaffirmsitscommitmenttoensuringthatanykindofdiscriminationanddistinctionbetweencitizensofAfghanistanshallbeforbidden,andensuringtherightsandfreedomsthatareguaranteedtoallAfghansunderAfghanlawandtheAfghanConstitution.ConsistentwithitsConstitutionandinternationalobligations,Afghanistanshallensureandadvancetheessentialroleofwomeninsociety,sothattheymayfullyenjoytheireconomic,social,political,civilandculturalrights.
III.ADVANCINGLONG-TERMSECURITY
1.ThePartiesreaffirmthatthepresenceandoperationsoftheU..S.forces
in
Afghanistansince2001areaimedatdefeatingal-Qaedaanditsaffiliates.ThePartiesacknowledgethegreatsacrificesandsufferingthattheAfghanpeoplehaveenduredinthestruggleagainstterrorismandthecontinuedthreatstotheirdesireforpeace,securityandprosperity.ThePartiesalsopaytributetothesacrificesmadebythepeopleoftheUnitedStatesinthisstruggle.2.InordertostrengthensecurityandstabilityinAfghanistan,contributetoregionalandinternationalpeaceandstability,combatal-Qaedaanditsaffiliates,andenhancetheabilityofAfghanistantodeterthreatsagainstitssovereignty,security,andterritorialintegrity,thePartiesshallcontinuetofosterclosecooperationconcerningdefenseandsecurity
 
-3-arrangements,asmaybemutuallydetermined.a.TheParties'respectiveobligationsunderthisAgreement,andanysubsequentarrangements,arewithoutprejudicetoAfghansovereigntyoveritsterritory,andeachParty'srightofself-defense,consistentwithinternationallaw.b.ThePartiesshall,subjecttotheirinternalprocedures,initiatenegotiationsonaBilateralSecurityAgreement.NegotiationsshouldbeginafterthesigningofthisStrategicPartnershipAgreement,withthegoalofconcludingwithinoneyearaBilateralSecurityAgreementtosupersedethe
AgreementregardingtheStatusojUnitedStatesMilitaryandCivilianPersonneloftheUs.DepartmentofDefensePresentinAfghanistaninconnectionwithCooperativeEffortsinResponsetoTerrorism,Humanitarian,andCivicAssistance,MilitaryTrainingandExercises,andOtherActivities
(2003),andothersuchrelatedagreementsandunderstandingsthataremutuallydeterminedtobecontrarytotheprovisionsoftheBilateralSecurityAgreement.c.Theconductofongoingmilitaryoperationsshallcontinueunderexistingframeworks,whichincludethe
MemorandumojUnderstandingontheTransferofU
S.
DetentionFacilities(2012)
andthe
MemorandumofUnderstandingontheAfghanizationojSpecialOperations(2012),
untilsupersededbytheBilateralSecurityAgreementorotherarrangements,asmutuallydetermined.Thisobligationiswithoutprejudicetothestatus,commitments,andunderstandingsofthoseframeworks,untilsupersededasnotedabove.3.Tohelpprovidealong-termframeworkformutualsecurityanddefensecooperation,theUnitedStatesshalldesignateAfghanistana"MajorNon-NATOAlly."

ThePartiesunderscoretheirstrongsupportforAfghaneffortstowardspeaceandreconciliation.a.Thenecessaryoutcomesofanypeaceandreconciliationprocessareforindividualsandentitiesto:breaktieswithal-Qaeda;renounceviolence;andabidebytheAfghanConstitution,includingitsprotectionsforallAfghanwomenandmen.b.Afghanistanaffirmsthatinallstateactionsandunderstandingswithregardtopeaceandreconciliation,itshallupholdthevaluesoftheAfghanConstitution.5.Beyond2014,theUnitedStatesshallseekfunds,onayearlybasis,tosupportthetraining,equipping,advising,andsustainingoftheAfghanNationalSecurityForces(ANSF),sothatAfghanistancanindependentlysecureanddefenditselfagainstinternalandexternalthreats,andhelpensurethatterroristsneveragainencroachonAfghansoilandthreatenAfghanistan,theregion,andtheworld.a.Suchsupportshould:(1)helpbuildappropriatecapabilitiesreflectingthe
