AND
THEUNITEDSTATESOFAMERICAI.PREAMBLE
TheIslamicRepublicofAfghanistan("Afghanistan")andtheUnitedStatesofAmerica("UnitedStates")havepartneredcloselysince2001torespondto
threats
tointernationalpeaceandsecurityandhelptheAfghanpeoplechartasecure,democratic,andprosperous
future.
Asaresult,Afghanistanisnowonapathtowardssustainableself-relianceinsecurity.governance.economicandsocialdevelopment,andconstructivepartnershipattheregionallevel.ThePartiesexpresstheirappreciationfortheNovember2011TraditionalLoyaJirga,whichdeclared:"Emphasizingtheneed
to
preservetheachievementsofthepasttenyears,respecttheAfghanConstitution,women's
rights,
freedomofspeech,andtakingintoconsiderationtheprevailingsituationintheregion,strategiccooperationwiththeUnitedStatesofAmerica,whichisastrategicallyofthepeopleandgovernmentofAfghanistan,isconsideredimportantinorder
to
ensurepolitical,economicandmilitarysecurityofthecountry.SigningastrategiccooperationdocumentwiththeUnitedStatesconformswiththenationalinterestofAfghanistanandisofsignificantimportance..WhensigningthisdocumentAfghanistanandtheUnitedStatesmust
be
consideredastwosovereignandequalcountries",inaccordancewiththeCharteroftheUnitedNations.EmphasizingtheirshareddeterminationtofurtheradvancetheAfghanpeople'sdesireforastableandindependentAfghanstate,governedonthebasisofAfghanistan'sConstitutionandshareddemocraticvalues,includingrespectforthefundamentalrightsandfreedomsofallmenandwomen,AfghanistanandtheUnitedStates("theParties")committostrengthenlong-termstrategiccooperationinareasofmutualinterest,including:advancingpeace,security,andreconciliation;strengtheningstateinstitutions;supportingAfghanistan'slong-termeconomicandsocialdevelopment;andencouragingregionalcooperation.Recognizingthecontinuedrelevanceoftheircommitmentsatthe2010LondonandKabulConferences,aswellasthe2011BonnConference,thePartiesaffirmtheirresolve
to
strengthenAfghanistan'sinstitutionsandgovernancecapacitytoadvancesuchareasoflong-termstrategiccooperation.CooperationbetweenAfghanistanandtheUnitedStatesisbasedonmutualrespectandsharedinterests-mostnotably,acommondesireforpeaceandtostrengthencollectiveeffortstoachievearegionthatiseconomicallyintegrated,andnolongerasafehavenforal-Qaedaanditsaffiliates.AfghanistanandtheUnitedStatesgoforwardinthispartnershipwithconfidencebecausetheyarecommittedtoseekingafutureofjustice.peace,security,andopportunityfortheAfghanpeople.Respectforthesovereigntyandequalityofstatesconstitutesthefoundationofthispartnership.
 
Respectfortheruleoflaw,aswellasthesoundandtransparentadherencetoAfghanistan'sConstitutionandallotheropemtivelaws,reinforcesitsfoundation.ThePartiesreaffirmtheirstrongcommitment
to
thesovereignty,independence,territorialintegrityandnationalunityofAfghanistan.Accordingly,thePartiesagree
to
thefollowing:

PROTECTINGANDPROMOTINGSHAREDDEMOCRATICVALVES
1.ThePartiesagreethatastrongcommitmenttoprotectingandpromotingdemocraticvaluesandhumanrightsisafundamentalaspectoftheirlong-termpartnershipandcooperation.2.UnderscoringthecentralimportanceofthevaluesandprinciplesoftheAfghanConstitution.Afghanistanreaffirmsitsstrongcommitmenttoinclusiveandpluralisticdemocraticgovernance,includingfree,fair,andtransparentelectionsinwhichallthepeopleofAfghanistanparticipatefreelywithoutinternalorexternalinterference.Reaffirmingitscommitmentsmadeatthe2011BonnConference,Afghanistanshallstrengthenandimproveitselectoralprocess.3.Afghanistanreaffirmsitscommitment
to
protectinghumanandpoliticalrightsunderitsConstitutionandinternationalobligations,includingtheInternationalCovenantonCivilandPoliticalRights.
In
thisregard,Afghanistanshallstrengthentheintegrityandcapacityofitsdemocraticinstitutionsandprocesses,includingbytakingtangiblestepstofurthertheefficiencyandeffectivenessof
its
threebranchesofstate,withinitsunitarysystemofgovernment,andsupportingdevelopmentofavibrantcivilsociety,includingafreeandopenmedia.4.AfghanistanreaffirmsitscommitmenttoensuringthatanykindofdiscriminationanddistirictionbetweencitizensofAfghanistanshall
be
forbidden,andensuringtherightsandfreedomsthatareguaranteedtoallAfghansunderAfghanlawandtheAfghanConstitution.ConsistentwithitsConstitutionandinternationalobligations,Afghanistanshallensureandadvancetheessentialroleofwomeninsociety,sothattheymayfullyenjoytheireconomic,social,political.civilandculturalrights.

ADVANCINGLONG-TERMSECURITY

1.ThePartiesreaffirmthatthepresenceandoperationsoftheU.S.forcesinAfghanistansince2001areaimedatdefeatingal-Qaedaanditsaffiliates.ThePartiesacknowledgethe
great
sacrificesandsuffering
that
theAfghanpeoplehaveendured
in
thestruggleagainstterrorismandthecontinued
threats
to
theirdesireforpeace,securityandprosperity.ThePartiesalsopaytributetothesacrificesmadebythepeopleoftheUnitedStatesinthisstruggle.2.Inordertostrengthensecurityandstability
in
Afghanistan,contribute
to
regionaland
 
internationalpeaceandstability,combatal-Qaedaanditsaffiliates,andenhancetheabilityofAfghanistantodeterthreatsagainstitssovereignty.security,andterritorialintegrity.thePartiesshallcontinuetofosterclosecooperationconcerningdefenseandsecurityarrangements,asmaybemutuallydetermined.

TheParties'respectiveobligationsunderthisAgreement,andanysubsequentarrangements,arewithoutprejudicetoAfghansovereigntyoveritsterritory,andeachParty'srightofself-defense,consistent
with
internationallaw.b.ThePartiesshall,subjecttotheirinternalprocedures,initiatenegotiationsonaBilateralSecurityAgreement.NegotiationsshouldbeginafterthesigningofthisStrategicPartnershipAgreement,withthegoalofconcludingwithinoneyearaBilateralSecurityAgreementtosupersedethe
AgreementregardingtheStatusofUnitedStatesMilitaryandCivilianPersonnelofthe
u.s.
DepartmentofDefensePresentinAfghanistaninconnectionwithCooperativeEffortsinResponsetoTerrorism,Humanitarian,
and
CivicAssistance,
Military
Training
and
Exercises,
and
OtherActivities
(2003),andothersuchrelatedagreementsandunderstandingsthataremutuallydeterminedtobecontrarytotheprovisionsoftheBilateralSecurityAgreement.c.Theconductofongoingmilitaryoperationsshallcontinueunderexistingframeworks,whichincludethe
MemorandumofUnderstandingontheTransferofU.S.DetentionFacilities(2012)
andthe
Memoranduma/UnderstandingontheAfgiJanizationofSpecialOperations(2012),
untilsupersededbytheBilateralSecurityAgreementorotherarrangements,asmutuallydetermined.Thisobligationiswithoutprejudicetothestatus,commitments,andunderstandingsofthoseframeworks,untilsupersededasnotedabove.3.Tohelpprovidealong-termframeworkformutualsecurityanddefensecooperation,theUnitedStatesshalldesignateAfghanistana"MajorNon-NATOAlly."4.ThePartiesunderscoretheirstrongsupportforAfghaneffortstowards
peace
andreconciliation.

Thenecessaryoutcomesof
any
peaceandreconciliationprocessareforindividualsandentities
to;
breaktieswithal-Qaeda;renounceviolence;andabidebytheAfghanConstitution,includingitsprotectionsforallAfghanwomenandmen.b.Afghanistanaffirmsthatinallstateactionsandunderstandingswithregard
to
peaceandreconciliation,itshallupholdthevaluesoftheAfghanConstitution.5.Beyond2014,theUnitedStatesshallseekfunds,onayearlybasis,tosupportthetraining,equipping,advising,andsustainingoftheAfghanNationalSecurityForces(ANSF),sothat
