COMUNICADO URGENTE Ante la opinin pblica nacional e internacional, ante los ltimos acontecimientos sucedidos en el municipio de Santa Cruz

Barillas Huehuetenango MANIFESTAMOS: El da de ayer a eso de la una de la tarde; hombres armados emboscaron a tres personas, lderes comunitarios; que retornaban de la cabecera municipal hacia su comunidad cercana a Posa Verde, lugar donde la empresa hidrosanta cruz pretende construir una hidroelctrica; como resultado de ese atentado el seor Andrs Francisco Miguel resultado fallecido y gravemente heridos Pablo Antonio Pablo y Esteban Bernab; uno de ellos se ha negado a vender sus tierras y ha sufrido persecucin legal por parte de empresa. Las personas heridas en este hecho, relataron que sus agresores se conducan en vehculos similares a los de la empresa Hidro Santa Cruz, por lo que poblacin asumio que este acto fue promovido por personas vinculadas a dicha empresa, lo cual tiene relacin con la denuncia que se hizo hace dos semanas cuando los comunitarios descubrieron y denunciaron a las autoridades correspondientes; la existencia de explosivos caseros en las instalaciones de la empresa; a ello se suma las acciones de intimidacin que la empresa ha impulsado para hacer valer sus intereses como la persecucin legal, coptacin de lderes, mensajes telefnicos con amenazas. Es de hacer notar que los conflictos sociales en Barillas estn directamente relacionados con la autorizacin y operaciones de Hidro Santa Cruz, S.A. que ha sido favorecida por los gobiernos de turno, sin dar cumplimiento al Derecho a la consulta previa, libre e informada los habitantes afectados. Ante esta situacin pobladores indignados reaccionaron de forma enardecida exigiendo justicia y provocando disturbios; y como consecuencia el gobierno evala declarar Estado una de las formas de limitacin de los derechos constitucionales. EL CONSEJO DE PUEBLOS DE OCCIDENTE y organizaciones de derechos humanos y ecologistas, manifestamos nuestra preocupacin por el manejo de la informacin que est siendo tergiversada a favor de la empresa; queremos aclarar enfticamente nuestro rechazo a los actos vandlicos sucedidos en Santa Cruz Barillas; pero tambin es necesario tomar en cuenta que esta reaccin es consecuencia y resultado de la imposicin de un proyecto por parte de la empresa Hidrosanta Cruz y el aval del gobierno, sin el consentimiento de la poblacin; hasta la fecha la resistencia de la poblacin ha sido pacifica, los disturbios que el da de ayer se suscitaron tienen su origen en la emboscada y asesinato de un lder comunitario as como dos heridos. Para encontrar una rpida solucin a este conflicto, Exigimos: A) La inmediata suspensin de la licencia de construccin y operacin de la Hidroelctrica Cambalam. B) El retiro de esta empresa en la zona; como responsable de la conflictividad social en Barillas y que se investigue su responsabilidad en este hecho. C) Que se conforme una comisin de alto nivel con participacin de organizaciones de la Sociedad Civil, para apoyar la investigacin y deduccin de responsabilidades sobre lo ocurrido. D) Que el Gobierno de Guatemala, brinde proteccin y seguridad a la poblacin de Barillas y no la suspensin de sus derechos constitucionales, sobre la base de la seguridad democrtica en el marco de los Acuerdos de Paz. URGENT COMMUNIQUE To the national and international public, regarding the recent events in the municipality of Santa Cruz Barillas Huehuetenango, WE DECLARE: Yesterday, at around one o'clock in the afternoon, armed men ambushed three community leaders as they returned from the municipal center to their nearby community of Posa Verde, where the Hidro Santa Cruz company plans to build a hydroelectric dam. In the attack, Andrs Francisco Miguel was killed, and Pablo Antonio Pablo and Esteban Bernab were seriously injured. One of the men had refused to sell his land and had suffered legal persecution by the company. According to the people injured in the incident, their aggressors were traveling in vehicles similar to those used by the Hidro Santa Cruz company. The local population assumed that people linked to the company were involved in the incident, due to the use of the vehicles, as well as other recent events. Two weeks ago, community members filed a legal complaint with the authorities after discovering homemade explosives in company facilities. Others have reported acts of intimidation, including legal persecution, the co-opting of leaders, and threatening phone messages, carried out to protect company interests. It should be noted that the social conflicts in Barillas are directly related to the project authorization and operations of Hidro Santa Cruz, S.A. The company has been favored by multiple governments, but has failed to respect the affected populations right to free, prior and informed consultation. Reacting to this situation, indignant community members acted with anger to demand justice and provoked riots. As a result, the government is evaluating the declaration of a state [of siege], thereby limiting constitutional rights. THE WESTERN PEOPLES' COUNCIL, along with human rights and environmental organizations, emphatically state our rejection of the vandalism committed in Santa Cruz Barillas. At the same time, however, we believe that these acts are the result of the imposition of the Hidro Santa Cruz project, which is endorsed by the government, but does not have the consent of the affected population. In order to quickly resolve this conflict, WE DEMAND: A) The immediate revision of the respective file and the suspension of the construction and operation licenses for the Cambalam hydroelectric dam. B) The withdrawal of the company from the area and an investigation into [potential] company responsibility for the incident. C) The formation of a high-level commission, with the participation of civil society organizations, to support the investigation and the assignment of responsibility for the events that took place on May 1 of this year in Barillas. D) Government-provided protection and security for the population of Barillas, according to the concept of democratic security laid out in the Peace Accords, rather than the suspension of constitutional rights. DRINGENDE MITTEILUNG ZUM AUSNAHMEZUSTAND IN BARILLAS Angesichts der Ereignisse in Santa Cruz Barillas, Hueheutenango, Guatemala, teilen wir der nationalen und internationalen ffentlichkeit mit: Am 1. Mai um 13 Uhr berfielen bewaffnete Mnner drei Anfhrer einer Dorfgemeinschaft auf dem Weg vom Barillas zurck in ihr Dorf in der Nhe von Posa Verde. Dort plant Hidro Santa Cruz den Bau eines Elektrizittswerks. Andrs Francisco Miguel erlag diesem Attentat, Pablo Antonio Pablo und Esteban Bernab berlebten nur mit schweren Verletzungen. Einer der angegriffenen Mnner weigerte sich bis anhin, dem Elektrizittsunternehmen sein Land zu verkaufen. Dafr wurde er strafrechtlich verfolgt. Die bei diesem Angriff verletzten Personen erwhnten, dass die Angreifer in gleichen Fahrzeugen unterwegs waren, wie sie Hidro Santa Cruz verwendet. Aus diesem Grund sagten die AnwohnerInnen aus, dass der Angriff von Leuten mit Verbindungen zu diesem Unternehmen ausgegangen ist. Bereits vor zwei Wochen wurde eine Anzeige gegen Hidro Santa Cruz eingereicht, weil Anwohner selbsthergestellte Sprengstze bei Installationen des Unternehmens vorgefunden hatten. Zu diesen Ereignissen kommen weitere Einschchterungen wie Strafverfahren, Vereinahmung von Anfhrern oder Drohungen per Telefon. Die sozialen Konflikte in Barillas stehen in einem direkten Zusammenhang mit den Aktivitten von Hidro Santa Cruz. Das Elektrizittsunternehmen hat die Erlaubnis zum Bau eines Kraftwerks erhalten, ohne dass die betroffene Bevlkerung ihr Recht auf eine vorgngige, freie, informierte und verbindliche Konsultation htte ausben knnen. Angesichts dieser aufgeheizten Situation reagierten emprte Bewohner, verlangten Gerechtigkeit und es kam zu Unruhen. Daraufhin erklrte die Regierung den Ausnahmezustand und schrnkte damit die verfassungsmssigen Rechte der Bevlkerung ein. Der CONSEJO DE PUEBLOS DE OCCIDENTE (Rat der Vlker des Westens), sowie mehrere Menschenrechts- und Umweltorganisationen sind besorgt ber die Berichterstattung, die fast ausschliesslich die Sichtweise des Unternehmens widergibt. Wir verurteilen die Gewalt in Santa Cruz Barillas, aber stellen klar, dass die Ereignisse ein Resultat der Tatsache sind, dass das Projekt von Hidro Santa Cruz der Bevlkerung aufgezwungen wurde. Die Regierung hat das Projekt gebilligt, ohne zuvor die Bevlkerung zu befragen. Bis jetzt blieb der Widerstand gegen das Kraftwerk friedlich. Die Unruhen von gestern gingen vom berfall und Mord eines Anfhrers und zwei Verletzten aus. Fr eine rasche Lsung dieses Konflikts fordern wir: a) Die sofortige Aufhebung der Lizenz fr den Bau und den Betrieb des Kraftwerks Cambalam. b) Den Rckzug von Hidro Santa Cruz aus der Region. Dieses Unternehmen ist verantwortlich fr die sozialen Konflikte in Barillas. Seine Beteiligung an den Vorfllen vom 1. Mai muss untersucht werden. c) Eine hochrangige Untersuchungskommission mit der Beteiligung von Organisationen der Zivilgesellschaft welche die Geschehnisse und Verantwortlichkeiten der in Barillas untersucht und aufklrt. d) Die Regierung Guatemalas muss den Schutz und die Sicherheit der Bevlkerung von Barillas gewhrleisten. Diese Verantwortung bernimmt sie nicht durch die Einschrnkung der verfassungsmssigen Rechte, welche demokratisch abgesichert sind und auf den Friedensvertrgen von 1996 basieren. Huehuetenango, 2. En av dem har vgrat att slja sin egendom till fretaget och har polisanmlts av fretaget. De som skadades i denna incident rapporterar att deras angripare krde fordon som liknar dem som gs av fretaget Hidro Santa Cruz, och drfr antas det att attacken utfrdes av personer med kopplingar till fretaget. En tidigare hndelse med anknytning till detta fall r polisanmlan som gjordes mot fretaget fr tv veckor sedan nr hemmagjorda sprngmnen hittades p omrde som gs av bolaget. Dessutom ansvarar fretaget fr trakasserier som juridisk frfljelse och hotfulla telefonsamtal i syfte att frsvaga ledare fr sociala rrelser. Det br noteras att de sociala konflikterna i Barillas har en direkt koppling till Hidro Santa Cruz SA verksamhet som ftt godknnade frn flera p varandra fljande regeringar utan att ta hnsyn till lokalbefolkningsns rtt att konsulteras p frhand. P grund av denna situation, reagerade ursprungsfolket aggressivt, krvde rttvisa och orsakade strningar. Som en fljd drav beslutade regeringen att utlysa ett undantagstillstnd som begrnsar de konstitutionella rttigheterna. Folkets rd i vst (EL Consejo de Pueblos De Occidente), mnniskorttsorganisationer och miljaktivister, uttrycker vr oro ver att information snedvrids till frmn fr fretaget. Vi motstter oss eftertryckligt den vandalism som intrffade i Santa Cruz Barillas, men det r ocks ndvndigt att notera att denna reaktion r en fljd av infrandet av ett projekt som stdjs av regeringen och som genomfrs av fretaget Hidro Santa Cruz, utan att befolkningen givit sitt medgivande. Hittills har folkats motstnd varit fredligt. Grdagens hndelser beror p bakhllet dr en av civilsamhllets ledare mrdades och tv andra skadades. Fr att hitta en snabb lsning p denna konflikt krver vi: A) Ett omedelbart upphvande av tillstndet fr uppfrande och drift av vattenkraftverket som drivs av Hidro Santa Cruz. B) Att fretaget drar sig tillbaka frn omrdet och att ansvaret fr oroligheterna i Barillas utreds. C) Att det bildas en kommission med deltagande av civilsamhllets organisationer som bidrar till att underska hndelserna. D) Att Guatemalas regering garanterar befolkningens skerhet, i stllet fr att dra in de konstitutionella rttigheterna, samt att demokratin skyddas p s stt som anges i fredsavtalen.
