TheHonorableKurtZellersSpeakeroftheHouseStateOfficeBuilding,Room463100Rev.Dr.MartinLutherKing,Jr.Blvd.St.Paul,Minnesota55155DearMr.Speaker:IhavevetoedandamreturningChapter274,HouseFile1870.Lastyear,theLegislatureandmyadministrationmadeexceptionalprogressinpassingandimplementingmajorK-12educationreforms.Theyincluded:AlternativeLicensureforteachers,EarlyChildhoodinitiatives,ReadingProficiencybythirdgrade,expandingPostsecondaryEnrollmentOptions,andnumerousothers.Mostimportantly,forthefirsttimeinadecade,weincreasedthestate'sper-pupilaidpaymentby$50perstudentforthisyearandby$100fornextyear.AndweinitiatedbothTeacherEvaluationandPrincipalEvaluationsystems,whicharenowbeingestablishedandwillbeimplemented,accordingtothetimetableestablishedbytheLegislature.Weaccomplishedagreatdeallastyear,byworkingtogether.TheUSDepartmentofEducation'sapprovalofourNoChildLeftBehindwavier,alongwithoursuccessfulRacetotheTopapplication,istestimonytotheirconfidenceinthepositivedirectionofMinnesota'seducationinnovation.ThattremendousprogressisatributetotheexcellentleadershipofEducationCommissionerBrendaCasselliusandlegislatorsofbothparties.Inmy"StateoftheState"addresslastFebruary,Isaid,"1haveanovelidea.Let'sdevelopanyeducationinitiativesthisyearincooperationwithteachers,ratherthaninconflictwiththem."Unfortunately,despitemyrequestanddespitethetremendousprogresswemadelastyearthroughbipartisancooperation,membersofthemajoritycaucusesinboththeHouseandtheSenatehaveintroduced22billsinthissession,whichareanti-publicschools,anti-publicschoolteachers,oranti-collectivebargainingrights.MajoritycaucusmemberscontinuetodenigrateMinnesota'spublicschoolteachers,withlittleornorecognitionorappreciationfortheextraordinarilydedicatedworkalmostallofthemdounderever-morechallengingcircumstances.Thisbill,withtherhetoricaccompanyingit,isyetanotherexampleofthisprejudiceagainstpublicschoolteachers.Onceagain,theyaresingledoutas"theproblem,"forwhichsomelegislators'solutionistooverridethelong-establishedrightsoflocalschoolboardsandteachers'electedrepresentativestonegotiatethetermsoftheiremploymentandtheirdismissals.Whilethebillwoulddisplacethemostprevalentsystemfordeterminingteacherlayoffs,byseniority,itwouldreplace

withonlyvaguelyformulatedideas.Effective2016-17foralldistricts,layoff,discharge,anddemotionplansmustbebasedonteacherlicensurefields,theteacher'smostrecentevaluationoutcomesfromtheleasttomosteffectivecategory,andfromleasttogreatestseniority,includingprobationaryteachers,withineachcategory.

TheHonorableKurtZellersMay3,2012Page2However,thoseevaluationmethodologieshavenotyetbeenselectedortested.Nosuccessfulbusinesswouldtellitsemployees,"Infouryears,wearegoingtoinstituteanentirelynewsystemfordecidingwhostaysandwhogoes.Butwecan'ttellyouwhatthatsystemis,becausewehaven'tfigureditoutyet."Whowouldnotexpectemployees'moraleandperformancetosufferasaresult?Therearecurrentlyunderwayproperlycarefuldevelopment,thentesting,andthentrainingprogramsforbothteacherandprincipalevaluations.AstheattachedBackgroundPaperfromtheAmericanEducationalResearchAssociation:GettingTeacherEvaluationRight:ABackgroundPaperforPolicyMakersdocuments,thereisconsiderabledisagreementaboutwhataretheeffectivemeasurestoassessteachers'performance.Ifteachers'andprincipals'careersaretobedecidedbythosemeasures,itisimperativethattheybeaccurate,verifiable,andreliable.ThisbillestablishesSeptember2016asthestartingpointforthosenewsystemstodeterminelayoffs.
It
isunclearwhytheLegislaturefeelssuchanurgencytomandatesomethingthatwillnottakeeffectforfouryears.AftertheevaluationshavebeendesignedandtestedwouldbeafarmoreappropriatetimefortheLegislaturetodetermine,in2015or2016,howbesttoincorporatethemintolayoffdecisions.Additionally,CommissionerCasselliusandIagreethatthefargreaterchallengeishowtouseevaluationstooutplaceteachersandprincipalsatthetimeproblemsdevelop,ratherthanwaitingmonthsorevenyearsforalayoffsituationtodevelop.Thatiswhywebelievethecurrentapproach,whichwasenactedlastyearwithbipartisansupport,isamore
constructive
