BEFOREME,theundersignedauthority,anotarypublicinandfortheStateofTexas,onthisdayappearedJamesPagewhoispersonallyknowntome,andwho,afterbeingdulyswornaccordingtolaw,uponoathdeposedandsaid:"MynameisJamesPage.IamanemployeeoftheCityofDallas("City")ParksandRecreationDepartmentIamamaintenancemanagerfortheParksandRecreationDepartmentIsupervisethecareandmowingofthearea.InthepastmydutiesincludedsupervisingthecareandmaintenanceoftheWhiteRockLakePark,includingWinfreyPoint,andIamfamiliarwiththecurrentcareandmaintenanceofthePark.IhavebeenanemployeeoftheDepartmentforatleast24.5years.Iamcompetenttotestify,Ihavepersonalknowledgeofthemattersstatedherein,andtheyaretrueandcorrect.IamfamiliarwithWinfreyPointandtheareathat
has
beenleasedtotheDallasArboretumandBotanicalSociety("theArboretum")fortemporaryparking.AttachedasExhibit1isatrueandcorrectcopyoftheagreement.ExhibitBtotheagreementisanarealphotographofWinfreyPointandnotes3areas(A,B,andC)forthetemporaryparking.Theoverallareatobeusedfortheparkingisapproximately3acres.ThroughattendingseminarsandpersonalresearchwhenIbecamemanagerinDistrict1,IlearnedthehistoricalmaintenancepracticesoftheparkwhichincludedthepastpracticeoftheCitykeepingallareasoftheparkmowedinamanicuredfashion,involvingmowingapproximatelytwiceamonth.Becauseofbudgetaryreasons,theCityreducedthemowingscheduleforundevelopedareas.Theseareashavebeencalledwildflowerorno-mowareasbytheCity.TheCityiscurrentlymowingtheleasedareasatleastonceayear,usuallyinJuly.TheCitydoesspotmowingtocontrolJohnsongrassandhasatleastoncedoneacompletemowinginDecemberandJanuarytocontrolJohnsongrassandtodispersedriedwildflowerseedheadsbacktothesoil.Inaddition,theCityperformsstripmowingofcertainareasevery12to14daysaroundthenaturalgrassareasaspartofthestandardmowingpractice.Stripmowingcutstheturfaroundthereducedmowingareastoapproximately2to3inchesinheighttodefinethedifferencebetweenthestandardparkturfandnaturalarea.TheCityhasalsoperformedthisstandardmaintenancepracticetoincludestripmowingaroundallthreeareasleasedfortemporaryparking.InparkingareasAandC,stripmowingoccursalongthestreetsapproximately10to30feetintotheturfAFFIDAVITPage1of2
areaintheparkuptothenaturalareawhereparkingisplanned.InparkingareaB,approximatelyhalfoftheareaispartoftheCity'sregularstripmowing.UndertheagreementwiththeArboretumtherewillbenoconstructionofparkinglots.Thegrassintheareawillbemowedandthevehicleswillbeparkedonthegrassareas.TheCitywillremainresponsibleformowingtheareas.TheCityrecentlyconstructedathirdbaseballfield
at
WinfreyPointandprovidedparkingonaflex-basesurfaceforapproximately30to35vehicles.Theconstructionoftheparkinglotwasdoneduringthefallandearlywinterof2011.ThisyeartheCityhasaddedapproximately6moreacrestoitsno-mowareasatWhiteRockLakePark.Further,Affiantsayethnot."

THESTATEOFTEXASThisWinfreyPointParkingOperationsandMaintenanceAgreement("Agreement")ismadeandenteredintobyandbetweentheCITYOFDALLAS,amunicipalcorporation("City"),actingbyandthroughitsParkandRecreationBoardandtheDALLASARBORETUMANDBOTANICALSOCIETY,aTexasnon-profitcorporation("Society").WITNESSETH:WHEREAS,CityistheownerofWinfreyPoint(hereinafterreferredtoasthe"Premises"),amulti-useparkareawithcertaindevelopedandundevelopedareasthatisapproximately30acresinsize,onWhiteRockLake,locatedinDallasCounty,Texas,andisfurtherdescribedinExhibitA,attachedtoandmadeapartofthisAgreement;andWHEREAS,SocietyisTexasnon-profitcorporationwhoseprimarypurposeistoestablish,maintain,promoteandoperateoneormorearboretaandbotanicalgardenforthebenefitofthepublicanditsmembers;andWHEREAS,CityisowneroftheDallasArboretum,consistingofapproximately66acresofland,andcertainbuildingsandimprovementslocatedthereon(collectivelyreferredtoasthe"Arboretum"),locatedat8617GarlandRoadandwithinthecitylimitsoftheCityofDallas;andWHEREAS,Societyhasalong-standinghistoryofestablishing,maintaining,promotingandoperatingtheArboretum;andWHEREAS,asaresultofconstructiontakingplaceattheArboretum,theexistingparkingavailableattheArboretumhasbeenreduced;andWHEREAS,SocietymayalsolosetheabilitytoutilizethepropertyatGarlandRoadandGastonAvenueforoverflowparking;andWHEREAS,beginninginMay2012the"ChihulyattheDallasArboretum"exhibitwillbeopenattheArboretum;andWHEREAS,similarexhibitionsbytheartistDale
