To amend sections 184.19 and 5727.81 and to enactsection 184.05 of the Revised Code to authorizethe Third Frontier Commission to award grantsrelated to the establishment and operation of datacenters and the development of a high speed fiberoptic network in the state, and to authorize akilowatt-hour excise tax reduction for electricdistribution companies supplying such centers at adiscounted rate.123456789
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1.
That sections 184.19 and 5727.81 be amended andsection 184.05 of the Revised Code be enacted to read as follows:1011
Sec. 184.05.
(A) As used in this section: 12(1) "Data center" means a facility that is primarily used tohouse tangible personal property that is or will be used inproviding data center services.131415(2) "Data center services" means electronic informationservices as defined in section 5739.01 of the Revised Code or anysimilar services, as may be further determined by the third161718
 
frontier commission. "Data center services" does not includeelectronic publishing as defined in section 5739.01 of the RevisedCode.192021(3) "Eligible partnership" means a partnership between afor-profit business entity and a state institution of highereducation.222324(4) "State institution of higher education" has the samemeaning as in section 3345.011 of the Revised Code.2526(B) The data center development grant program is herebycreated to promote the establishment of data centers in the state.The third frontier commission shall award grants on a competitivebasis to eligible partnerships for the establishment and operationof data centers. The amount awarded to a single eligiblepartnership shall not exceed five million dollars. The totalamount of grants awarded under the program shall not exceed fiftymillion dollars. Grants shall be made from the third frontierresearch and development fund created under section 184.19 of theRevised Code.27282930313233343536(C) The data center high speed fiber optic network grantprogram is hereby created to promote the development of a highspeed fiber optic network in the state and to assist in theprovision of high speed fiber optics to data centers. The thirdfrontier commission shall award grants to persons that providehigh speed fiber optics to a data center that has been or will beestablished in this state with the assistance of a grant awardedunder division (B) of this section. The total amount of grantsawarded under the program shall not exceed twenty-five milliondollars. Grants shall be made from the third frontier research anddevelopment fund created under section 184.19 of the Revised Code.3738394041424344454647(D) The third frontier commission shall adopt rules underChapter 119. of the Revised Code that are necessary for the4849

administration of the data center development grant program andthe data center high speed fiber optic network grant program. Therules shall establish all of the following:505152(1) Specific eligibility criteria for grant applicants; 53(2) A definition of what constitutes "high speed fiberoptics" for purposes of the data center high speed fiber opticnetwork grant program;545556(3) Forms and procedures by which eligible applicants mayapply for grants under this section;5758(4) Criteria for reviewing, evaluating, and rankingapplications, and for approving applications from eligibleapplicants that best serve the goals of the data centerdevelopment grant program and the data center high speed fiberoptic network grant program;5960616263(5) Reporting requirements and monitoring procedures; 64(6) Any other rules necessary to implement and administer thegrant programs.6566(E) An eligible applicant that receives a grant under thedata center development grant program or the data center highspeed fiber optic network grant program is not precluded frombeing considered for or participating in other financialassistance programs offered by the department of development.6768697071
Sec. 184.19.
The third frontier research and development fundis hereby created in the state treasury. The fund shall consist ofthe net proceeds of the obligations issued and sold by the issuingauthority pursuant to sections 151.01 and 151.10 of the RevisedCode. Investment earnings of the fund shall be credited to thefund. Moneys in the fund shall be used in accordance with sections184.05, 184.10 to 184.18, and 184.20 of the Revised Code and forassociated administrative expenses.7273747576777879
