§
49-1.Title.
Thischaptershallbeknownasthe"CityofKingstonEthicsandDisclosureLaw."
§
49-2.Purpose;statutoryauthority.
A.
Thepurposesofthischapterareto:
(l)
Establishstandardsofethicalconductforofficers,employeesandconsultantsofCityofKingston;(2)Provideofficers,employeesandconsultantsofCityofKingston,whetherelectedorappointed,paidorvolunteer,withclearguidanceonsuchstandards;(3)Promotepublicconfidenceandintegrityintheagenciesandadministrativeofficesofourlocalgovernment;(4)Facilitatetheconsiderationofpotentialethicalproblemsbeforetheyarise,minimizeunwarrantedsuspicion,andenhancetheaccountabilityofgovernmenttothepeoplebyrequiringpublicdisclosureoffinancialintereststhatmayinfluenceorbeperceivedtoinfluencetheactionsofCityofKingstonofficersandemployees;and(5)Provideforthefairandeffectiveadministrationofthischapter.
B.
Thischapterisenactedpursuantto§806oftheGeneralMunicipalLawoftheStateofNewYorkand
§
10oftheMunicipalHomeRuleLawandisnotintendedtoauthorizeanyconductprohibitedbyArticle18oftheGeneralMunicipalLaw.
§
49-3.Definitions.
Unlessotherwisestatedorunlessthecontextotherwiserequires,thefollowingtermsshall,forthepurposeofthischapter,havethemeaninghereinindicated:
APPEARandAPPEARBEFORE
Communicatinginanyform,including,withoutlimitation,personally,throughanotherperson,byletter,orbytelephoneorelectronicmeans.
BOARDOFETHICS
TheBoardofEthicsoftheCityofKingstonestablishedpursuantto
§
49-8ofthischapter.
CHIEFFISCALOFFICER
TheCityComptrollerorotherofficerpossessingsimilarpowersandduties.
CONTRACT
Anyclaim,accountordemandagainstoragreementwiththeCity,expressorimplied,andshallincludethedesignationofadepositoryofpublicfundsandthedesignationofanewspaper,includingbutnotlimitedtoanofficialnewspaper,forthepublicationofanynotice,resolution,ordinance,locallaworotherproceedingwheresuchpublicationisrequiredorauthorizedbylaw.
CONTRACTUALGOODS/SERVICES
AnyworkperformedorgoodsdeliveredbyaCityofficertoanotherpersonundermutualagreementofthetwopartiesandprovidedthetransactionhasbeenfinalized,withoutdispute,bythetwoparties.
CITY
CityofKingston,andshallincludetheKingstonLocalDevelopmentCorporationorotherentityownedand/oroperatedbytheCityorajointserviceestablishedforthepurposeofcarryingon,performingorfinancingoneormoreimprovementsorservicesintendedtobenefitthehealth,welfare,safetyorconvenienceoftheinhabitantsoftheCityortobenefittherealpropertywithintheCity.
CITYOFFICEROREMPLOYEE
AnyofficeroremployeeoftheCity,whetherpaidorunpaid,andincludes,withoutlimitation,allmembersofanyoffice,board,body,advisoryboard,council,commission,agency,department,district,administration,division,bureauorcommitteeoftheCity."Cityofficeroremployee"shallnotinclude:
A.
Ajudge,justice,officeroremployeeofthecourtsystem;or
B.
AmemberofanadvisoryboardoftheCityif,butonlyif,theadvisoryboardhasnoauthoritytoimplementitsrecommendationsortoactonbehalfoftheCityortorestricttheauthorityoftheCitytoact.NoentityestablishedpursuanttotheGeneralMunicipalLawoftheStateofNewYorkshallbedeemedanadvisoryboardforpurposesofthissubsection.
CUSTOMERorCLIENT
AnypersonforwhomaCityofficeroremployeehasdirectlysuppliedcontractualgoods/servicesduringtheprevious24months.

Apersonatleast18yearsofagewho,withrespecttoanotherperson:
