COMES NOW, making a special appearance, Daniel Riley, acting in a sovereign
capacity, Sui Juris, not Pro Se repeat not Pro Se representing the fiction DANIEL
RILEY, and makes this motion, prima facie. In no way can this motion be construed to
‘grant jurisdiction over the defendant, because the deiendant’s counsel still contends no
jurisdiction exist. In no way should this motion be construed to be considered a contract
and all rights are reserved at the common law UCC 1-308 and 1-103.6 without prejudice.
1. The defendant makes this motion in accordance with local rule 42.1 and
FRCP rule 14, and objects to any consolidation of the defendant’s case with another casc.
The defendant having been represented by counsel appointed by the court, against
objections by the defendant, and fhat very counsel refusing to represent the defendant the
way the defendant deemed to be his best interest, including to file an objection to the
consolidation of this case, and the defendant finally after three months being able to
represent himself and actually file motions, files this motion now in 2 good faith showing,
2. The defendant motions this court to grant a severance and will arguc, if
the consolidation is allowed to proceed, then to have all defendants allowed to
communicate as one, since the defendants are going to be tried as one. This defendant
will argue that to properly defend himself in a consolidated trial he must be able to
communicate with his alleged co-defendants on a daily basis to form the best defense
possible anything less than that is a violation of the defendant’s procedural due process
rights to a fair trial guaranteed by the 5" and 6" Amendments .
