todiscussboththeproposedlocalrulesandthereorganizationplantosplitthedistrict.Afterthejudgesmet,theundersignedsubmittedafinal

oftheproposedlocalrules
to
theotherthree

circuitjudgesfortheirsignatures.Allthejudgesimmediatelysignedthefinalproposedlocalrules,exceptJudgeWeill.Thelocalrules,withthesignaturesofGowan,KiddandGreenwerereturnedunsignedtomyofficebyamemberofJudgeWeill'sstaff.Thereafter,theundersignedsubmittedthelocalrulestotheMississippiSupremeCourtforreviewandapproval.SubsequenttothesubmissionofthelocalrulestotheSupremeCourt,Petitionerindicatedhisapprovalofthelocalrules.

such,theundersignedisoftheopinionthatthelocalrulesarenotanissueinthismatter.OnApril
17,2012,
inaccordancewithSections

(1972,asamended)(bothbecameeffectiveSeptember6,1994,thedatethattheUnitedStatesAttorneyGeneralinterposednoobjectiontotheamendmentofthissection),theundersignedenteredanorderupontheminutesoftheHindsCountycircuitcourtreorganizingtheFirstJudicialDistrictoftheHindsCountyCircuitCourttosplitthedistrictintoacivilandcriminaldivision(ExhibitA).TheorderprovidedthatafterAugust
1,2012,
allcivilcaseswouldrandomlybeassignedtopresidingCircuitJudgesWinstonKiddandJeffWeill,Sr.TheorderalsostatedthatafterAugust1,2012,allcriminalcases,exceptcapitalmurderanddeathpenaltycaseswouldbeassignedtoCircuitJudgesTomieGreenandBillGowan.JudgeWeillquestionedtheundersignedonseveralmattersduringthejudges'March

meeting,toincludehowthejudgeswereassignedtoeachofthesplitdivisions.Healsoseemedtofocusonthecriminalcaseassignmentsunderthereorganizationplan.Afterthemeeting,theundersignedrevisedthecaseassignmentsinthesplitdivisionstostatethatallcapitalmurderanddeathpenaltycaseswouldberotatedamongallfour(4)circuitjudges.JudgesKiddandWeillwerealsogiventheoptionofretaininganycapitalmurderordeathpenaltycasespendingontheirdocketsasofAugust
1,2012.
Duringthemeetingthejudgeswerealsoawarethatanycircuitjudgewhobelievedthatthepartiesinacasependingonhisorhercurrentdocketwouldbeundulyprejudicedorburdenedbythereorganizationofthedocket,thenthepresidingcircuitjudgewouldkeepthecaseonhisorherdocketuntilfinaldisposition,regardlessofwhetherthejudgehadbeenassignedtothecivilorcriminaldivision.Likewise,theApril17,
2012
orderspecificallystated,
that
"nothingwithinthisordershallbeconstruedasprecludinganycircuitjudgefromagreeingtopresideinamatterorcaseofafellowcircuitjudgewithoutregardtowhetherthecaseiscivilorcriminal".
