THIS AGREEMENT OF LEASE is made on this 20
th
Day of Jan 2006BETWEEN Jatin Kakkar, S/o Mr. V P Kakkar, aged 29 Years residing at # 256Model Town, Sonipat, Haryana - 131001, hereinafter referred to as LESSOR(which term shall unless repugnant to the context mean and include his/her heirs, legal representatives, assigns and administrators) of the ONE PART :AND :Mr. Ved Vyas, S/o Shri C B Narayan Singh, Chhitrour, Begusarai, Bihar,-851129, hereinafter referred to as the LESSEE (which term shall unlessrepugnant to the context mean and include its successors-in-interest) of theOTHER PART :WHEREAS the Lessor is the absolute owner and in possession of theimmovable property bearing Flat No. C-407, Purva Heights, Bilekahalli, B GRoad, Bangalore - 560076, fully described in the Schedule hereunder andhereinafter referred to as the Schedule Property:: 2 :
 
AND WHEREAS the Lessor is desirous of giving on lease the above mentionedproperty and the Lessee is desirous of taking on lease the schedule property onthe terms and conditions hereinafter contained ; NOW THIS AGREEMENT WITNESSES AS FOLLOWS :1.The Lessor shall lease and the Lessee shall take on lease the propertyon the terms and conditions hereinafter contained.
2.
The lease of the schedule property shall commence from the<Le_Date>6 and shall in the first instance be for a period of <Period>1months.
 
The lease may be renewed there after for a further period of 11months with an increase of 10% on monthly rent payable. 
3.
The Lessee shall pay a monthly rent of <Rent> <Words> during theperiod of Lease for the schedule property. Such rent shall be paid by theLessee to the Lessor by cheque on or before the 5th of each month.Such payment representing rent payable for the current month.
4.
The Lessee agrees that upon or before taking vacant possession of thescheduled property in pursuance of this lease agreement it shall pay theLessor a sum of <Deposit> <Words1> as security deposit which shall berefunded by the him/her to the lessee without interest simultaneously withthe lessee handing over vacant possession of the schedule property tothe Lessor.
5.
Charges for electricity, & water consumed
 
in the schedule property shallbe borne and paid by the Lessee.6.The Lessee shall not sub-let the schedule property or part withpossession or occupation thereof or transfer or assign the tenancy rightsin favour of any one else except as hereinafter stated.
7.
The Lessor shall bear and pay the property taxes, rates and cesses etc.,payable to the Corporation of the City of Hyderabad in respect of theschedule property as also any increases therein.8.The Lessee shall not make any structural additions or alterations in theschedule property without the consent of the Lessor and will not removeany fittings and fixtures.contd.3
 
: 3 :9.The Lessee shall keep and maintain the schedule property in goodcondition and repair subject to normal wear and tear .On expiry of thelease period the Lessee shall quit and deliver vacant possession to theLessor, on the Lessor simultaneously refunding the deposit amount of <Deposit><Words1> as hereinbefore referred to.10.The Lessor or their authorised agents shall after due notice and duringday time, be entitled to enter upon the schedule property and inspect thesame to satisfy themselves that the schedule property is used inaccordance with the terms of the lease.11.The Lessor covenant with the Lessee that the Lessee on paying the rentshereby reserved shall be entitled to the peaceful possession and quietenjoyment of the schedule property during the period of the lease.12.In the event of the Lessee failing to pay the rents consecutively for a termof Two months or committing breach of any other term of the lease, theLessor shall be entitled to terminate the lease and re-enter upon theschedule property.
13.
Notwithstanding anything hereinbefore contained either the Lessor or theLessee shall be entitled to terminate this agreement/lease by giving tothe other <Not_Period> month written notice in that behalf. Thelease/agreement shall stand automatically terminated on the date somentioned in such notice. On such termination, the Lessee shall quit anddeliver vacant possession of the schedule property to the Lessor on theLessor simultaneously refunding the amount of security deposit, withoutany interest.
